我国房地产信托兑付危机法律问题研究

【摘要】:2010年以来,房地产信托规模一直保持快速增长,然而,在国家持续的房地产行业的调控措施下,房地产行业的发展模式也在悄然发生着变化,原有发展模式的风险也逐步显现出来。2013年,涉及房地产信托产品的兑付金额有望达到4000亿元,规模将接近2012年的两倍,特别是随着2013年第二季度兑付洪峰的来临,与之而来的法律问题层出不穷,,本文将分四章进行讨论分析。 从我国房地产市场的现实情况入手,进而扩充到我国房地产信托市场所现存的各类系统风险和非系统风险。第二章从近期可能出现的大规模房地产信托兑付危机现状入手,结合政策法律因素和市场因素对其形成原因进行分析,同时采取案例分析方法。第三章主要阐述我国目前对房地产信托兑付危机的防范和监管。第四章对我国房地产信托的监管及相关创新提出了一些新想法。 笔者认为目前房地产信托出现大规模兑付危机的可能性不大,但对此方面的法律监管却不可松懈,需从信托行业加强内部监管入手,同时辅以监管层面的法律政策调控,使我国的房地产信托行业进一步蓬勃发展。
[Abstract]:Since 2010, the scale of real estate trust has maintained a rapid growth. However, with the continuous regulation and control measures of the real estate industry, the development mode of the real estate industry is quietly changing. The risks of the original development model are also emerging. In 2013, the amount of repayments involving real estate trust products is expected to reach 400 billion yuan, which will be nearly twice the size of 2012, especially with the arrival of the Hong Feng payment in the second quarter of 2013. With the emerging of legal problems, this paper will be divided into four chapters to discuss and analyze. Starting with the reality of the real estate market in our country, it extends to all kinds of system risk and non-system risk existing in the real estate trust market of our country. The second chapter starts with the present situation of the large scale real estate trust payment crisis in the near future, analyzes the reasons for its formation by combining the policy and legal factors and the market factors, and adopts the case analysis method at the same time. The third chapter mainly elaborates our country to the real estate trust payment crisis prevention and the supervision. Chapter four puts forward some new ideas on the supervision and innovation of real estate trust in our country. The author thinks that there is little possibility of large-scale payment crisis in real estate trust at present, but the legal supervision in this respect cannot be relaxed. It is necessary to strengthen the internal supervision in the trust industry, and at the same time, to adjust and control the legal policy at the level of supervision. Make our country's real estate trust industry to further flourish.
