新时代信托股份有限公司信托业务风险管理研究

【摘要】：目前，我国信托业的盈利能力与受托规模及创造的收益水平等都已超过了公募基金业。产品形式、产品内容、产品模式及专业能力也逐步得到了大众的认可。然而，随着信托业的蓬勃发展，，一系列的问题也开始暴露出来了，甚至引起过局部的金融动荡。近日某著名信托公司的矿产信托出现了兑付危机，涉及的金额达到了几十亿，这也为信托风险管理敲响了警钟。新时代信托股份有限公司（以下简称“新时代信托”）在快速壮大的同时也仍存在着一系列的风险管理问题。本研究从市场风险、信用风险、流动性风险、政策法律风险及操作风险角度出发，对新时代信托的风险进行分析。通过实地调查，结合前人的研究，指出了其存在的问题，并找出了存在问题的原因，即公司治理结构不完善、缺乏风险管理人才、风险控制技术相对落后、风险管理制度不完善等。通过对这些原因的探寻，本研究通过相应的对策建议，即完善信托风险制度体系，完善市场风险制度体系，完善操作风险制度体系，完善流动性风险制度体系，完善政策法律风险制度体系，和这些对策建议可以得到实施的保障措施，即完善公司治理结构，内控建设，制定业务决策及风控委员会工作制度，建设人事管理制度及岗位职责制度，加强公司风险管理意识文件，推动信息化建设，建立突发风险事件处理机制来尽量避免新时代信托的信托业务发生风险。
[Abstract]:At present, the profitability, trust scale and income level of trust industry in China have exceeded the public fund industry. Product form, product content, product model and professional ability have been gradually recognized by the public. However, with the rapid development of the trust industry, a series of problems have been exposed and even caused by local financial turmoil. Recently, the payment crisis of a famous trust company's mineral trust, involving billions of dollars, also sounded the alarm for trust risk management. New era Trust Co., Ltd. (hereinafter referred to as "New Age Trust") has a series of risk management problems. This study analyzes the risks of trust in the new era from the perspectives of market risk, credit risk, liquidity risk, policy and legal risk and operational risk. Through field investigation, combined with previous studies, this paper points out the existing problems, and finds out the reasons for the problems, that is, the imperfect corporate governance structure, the lack of risk management talents, and the relatively backward risk control technology. The risk management system is not perfect and so on. Through the exploration of these reasons, this research through the corresponding countermeasures and suggestions, that is, to perfect the trust risk system, perfect the market risk system, improve the operational risk system, improve the liquidity risk system, Perfect the system of policy and law risk system, and these countermeasures and suggestions can be implemented, that is, improve the corporate governance structure, internal control construction, formulate business decision-making and work system of the wind control committee, In order to avoid the trust business risk in the new era, the personnel management system and the post responsibility system should be built, the company risk management consciousness document should be strengthened, the information construction should be promoted, and the emergency risk handling mechanism should be established to avoid the trust business risk as far as possible.
