供给侧结构性改革背景下“僵尸企业”的破产法应对

【摘要】：妥善处置"僵尸企业"是供给侧结构性改革的重要任务之一。"僵尸企业"占据着大量的优质资源,破坏了公平有序的市场竞争环境,严重制约了经济社会发展。以破产法为核心的法治化手段是处置"僵尸企业"的重要途径。文章分析了"僵尸企业"的识别方法、成因、危害以及妥善处置的必要性,提出了包括完善现行破产法在内的处置"僵尸企业"的若干建议,以期为供给侧结构性改革背景下"僵尸企业"的市场化、法治化出清提供保障机制。
[Abstract]:Properly handling "zombie enterprises" is an important part of supply-side structural reform. "zombie enterprises" occupy a large number of high-quality resources and undermine a fair and orderly market competition environment. It is an important way to deal with "zombie enterprise". This paper analyzes the identification method, cause of formation, harm and necessity of proper disposal of "zombie enterprise". This paper puts forward some suggestions on how to deal with "zombie enterprises", including perfecting the current bankruptcy law, in order to provide a guarantee mechanism for the marketization and legalization of "zombie enterprises" under the background of supply-side structural reform.
