【摘要】：特朗普总统执政伊始便宣布美国退出TPP。此举使TPP的前景充满了不确定性。但是TPP协定中有关国有企业的条款依然值得我们深入研究。中国作为从计划经济转轨的新兴市场经济国家,不仅拥有数量众多的国有企业,而且国有企业在经济发展中具有重要的地位和作用。然而,目前中国国有企业改革尚不完善。尽管中国没有参与TPP谈判,但是从中国国有企业改革这一视角出发,对TPP国有企业条款进行深入的研究,将有利于中国进一步深化国有企业改革;同时也有助于中国国有企业更好地参与全球分工、贸易以及投资活动。更何况国有企业条款也是目前正在进行的中美双边投资协定谈判(BIT)的重要内容之一。全文分为6章。第1章为导论。首先论述本文的研究背景和意义;在相关文献综述中,对关于TPP国有企业条款的产生原因、主要内容、对越南和新加坡的影响以及TPP国有企业条款影响下中国国有企业改革对策等四方面的文献进行了梳理和评述。第2章为对TPP国有企业条款内容的归纳分析。主要包括TPP国有企业议题的内涵界定与适用范围、TPP国有企业条款的主要内容、TPP国有企业条款的基本特点、TPP国有企业条款内容的后续完善。第3章探讨了 TPP国有企业条款对越南、新加坡国有企业的影响。透过TPP国有企业条款对越南和新加坡国有企业改革的影响及其应对方案,分析中国国有企业改革。第4章在前文对TPP国有企业条款研究的基础上,结合中国国有企业的定义和分类、历史沿革及发展现状,分析TPP国有企业条款对中国国有企业改革的影响,并对当前中国国有企业改革存在的问题进行归纳和总结。第5章分析了 TPP协定的现状,并对TPP国有企业条款对中国国有企业改革的倒逼意义进行论证,在此基础上,结合条款内容和中国国有企业发展现状,为中国国有企业改革提出了五项建议和对策:一是推进国企分类改革;二是完善政府补贴模式;三是深化国企混合所有制改革;四是规范相关制度建设;五是借鉴他国改革经验。第6章是对全文内容的总结。中国的国企改革的对策不应仅仅局限于本文的对策分析;而应立足长远,不断探索新的改革对策,持续推进国有企业改革进程。
[Abstract]:From the very beginning of President Trump's administration, President Trump announced the withdrawal of the United States from the TPP.The move leaves the outlook for TPP full of uncertainty.However, the provisions of the TPP agreement on state-owned enterprises are still worth our in-depth study.As an emerging market economy country in transition from planned economy, China has not only a large number of state-owned enterprises, but also state-owned enterprises play an important role in economic development.However, at present, the reform of Chinese state-owned enterprises is not perfect.Although China did not participate in the TPP negotiations, from the perspective of the reform of Chinese state-owned enterprises, the in-depth study of the terms of TPP state-owned enterprises will be conducive to further deepening the reform of state-owned enterprises in China.It also helps Chinese state-owned enterprises to better participate in global division of labor, trade and investment activities.Moreover, the SOE clause is also an important part of the ongoing bilateral Investment Treaty (bits) negotiations between China and the United States.The full text is divided into six chapters.Chapter 1 is an introduction.First of all, it discusses the background and significance of this paper. In the relevant literature review, the main content of the article about the TPP state-owned enterprises, the reasons for the emergence, the main content,This paper reviews the influence of Vietnam and Singapore and the reform countermeasures of Chinese state-owned enterprises under the influence of TPP clauses.Chapter 2 is the inductive analysis of the content of TPP state-owned enterprise clause.It mainly includes the connotation definition and applicable scope of the TPP state-owned enterprise issue and the main content of the TPP state-owned enterprise clause. The basic characteristics of the TPP state-owned enterprise clause are discussed and the further improvement of the content of the TPP state-owned enterprise clause is also given.Chapter 3 discusses the influence of TPP state-owned enterprise clause on state-owned enterprises in Vietnam and Singapore.This paper analyzes the reform of China's state-owned enterprises through the impact of the terms of TPP on the reform of state-owned enterprises in Vietnam and Singapore and its countermeasures.Chapter 4, on the basis of the previous research on the terms of TPP state-owned enterprises, combined with the definition and classification of Chinese state-owned enterprises, historical evolution and development status, analyzes the impact of the terms of TPP state-owned enterprises on the reform of state-owned enterprises in China.At the same time, the problems existing in the reform of Chinese state-owned enterprises are summarized and summarized.Chapter 5 analyzes the current situation of TPP agreement, and demonstrates the reverse significance of TPP state-owned enterprise clause to the reform of Chinese state-owned enterprise. On this basis, it combines the content of the clause and the current situation of the development of Chinese state-owned enterprise.This paper puts forward five suggestions and countermeasures for the reform of Chinese state-owned enterprises: first, to promote the reform of the classification of state-owned enterprises; second, to perfect the pattern of government subsidies; third, to deepen the reform of mixed ownership of state-owned enterprises; fourth, to standardize the construction of related systems;Fifth, learn from other countries' experience in reform.Chapter 6 is a summary of the full text.The countermeasures of the reform of state-owned enterprises in China should not be limited to the analysis of the countermeasures in this paper, but should be based on the long-term, constantly explore new reform countermeasures, and continue to promote the reform process of state-owned enterprises.
