基于合同参照点效应的建设项目承包人公平关切点研究

【摘要】：基于合同参照点效应,以建设项目发承包双方缔结的合同作为参照点,来识别和确认其中能诱发承包人公平感知的公平关切点。研究以国内典型地铁工程项目为例,采用两阶段内容分析对其合同进行编码,确定了承包人3个公平维度下的7个公平关切点。研究表明,合同中的风险责任、风险补偿、风险收益等条款是引发承包人分配公平感受的关切点;参与决策权及权利约束等条款是诱发承包人程序公平感受的关切点;而信息双向沟通与协调配合等条款是引起承包人互动公平感受的关切点。
[Abstract]:Based on the contract reference point effect, the contract concluded by both parties of the construction project is taken as the reference point to identify and confirm the fair concern point which can induce the contractor's fair perception. Taking typical subway engineering projects in China as an example, this paper uses two-stage content analysis to encode the contract, and determines seven fair concerns of contractors under three dimensions of fairness. The research shows that the terms of risk responsibility, risk compensation and risk return are the concern points that trigger the contractor's fair feeling of distribution, and the terms of participation in decision-making right and right restriction are the concern points to induce the contractor's fair feeling of procedure. The terms of information communication and coordination are the concerns of contractors.
