【摘要】：农业作为国民经济发展的命脉，是支撑国民经济建设与发展的基础性产品，如何解决因农村劳动力大量转移、不利于农业集体生产的天然因素等问题所造成的大量耕地、山地、丘陵的闲置，已是解决“三农问题”重要议题之一。为实现农村生产力的彻底解放，党和政府最近10年相继出台多项支农惠农政策，尤其是中央一号文件的出台，对于农村政治、经济、文化、医疗等方面建设具有重要的导向作用。其中在解决农村经济发展问题方面最为显著，也体现了国家对农村社会体制改革的重心，如取消农业税、实施对种粮农民直接补贴，增加对良种补贴、农机具补贴和重大农业技术推广专项补贴等，其中在有条件的地区，特别是一些经济比较发达的地区，不断探索农地使用权流转的形式，通过“土地入股”等多种形式加大农地使用权的流转力度，不断扩大农业生产经营规模以及最近出台的“鼓励和引导城市工商资本到农村发展适合企业化经营的种养业”等政策，通过吸引外部工商企业投资，城市带动农村，充分利用外部环境的技术、资金、人才等优势发展农业生产，实现农业产业化经营。这是我国社会主义公有制土地制度内容的重大创新和发展，对完善我国社会主义土地制度具有重要的理论和实践价值。然而，资金、技术雄厚的工商企业介入农村，对农用户的承包地进行流转，如果不加以法律和制度上的规制，难免会出现英国史上著名的“圈地运动”及“非粮化”、“非农化”，农民的土地不再是自己的土地，反而成为部分工商企业攫取不当利益的工具，破坏了社会的公平正义，是对公有制土地制度的破坏。因此，在工商企业租赁农户承包耕地方实行最严格的准入和监管等制度，，对于相关市场主体的市场行为具有积极的导向和规范作用，同样对于实现法律维护公平正义价值及政府依法治国理念具有重要价值。

This is a major innovation and development of land system of our country socialist public ownership, it is important to the value of the theory and practice of perfecting socialist land system in our country.
However, the business enterprise funds, technology strong intervention in rural areas, the agricultural users of the contracted land circulation, if not regulated by law and system, there will inevitably be a famous British history "enclosure movement" and "non food", "non agriculture", the farmers' land is no longer their land instead, become some businesses grab improper interests, undermine the fairness and justice of society, is the public ownership system of land destruction.
Therefore, the implementation of the most stringent access and supervision system in the business enterprise leasing contract farmers farming place, with guidance and positive role in regulating the market behavior of related market, also for the realization of legal justice value and government law concept has important value.
