完善我国慈善组织监管研究

【摘要】：近年来,随着政治、经济、文化的同步发展,慈善事业也出现了迅猛发展,其作为社会资源的第三次分配,调节了社会矛盾,缩小了贫富差距,保障了我国社会的稳定发展。但是慈善事业中的问题也不断的暴露出来,例如慈善组织的内部成员私吞慈善资源等。这些慈善腐败行为给社会公众带来了心灵上的打击,消解了公众对慈善事业的热情,公众不愿意将自己的钱捐助给慈善组织,严重影响了慈善组织的健康发展。因此,慈善监管的重要性日益显现。本文运用比较分析法、归纳法等研究方法,对慈善组织及慈善组织监管的概念进行了简单的论述,阐述了完善我国慈善组织监管的必要性,并论述了我国慈善组织监管的现状,指出了我国慈善组织法律监管的问题。西方国家在慈善监管方面有着悠久的历史,笔者主要梳理了英、美、德三个国家的慈善监管研究,总结了先进的经验启示。最后,针对我国慈善监管的现状及存在的问题,阐述了完善我国慈善组织监管的路径。慈善组织监管对我国慈善事业的发展具有不可替代的意义,维护了利益相关人的权益,保障了慈善组织的公信力,提高了社会公众参与慈善事业的热情,为慈善事业的运行发展提供了一个良好的、具有法律氛围的环境,促进慈善组织自身不断成熟,公信力不断提高。同时,对于促进我国监管体制改革的深入发展,建设和谐社会也具有重大意义。
[Abstract]:In recent years, with the simultaneous development of politics, economy and culture, philanthropy has also developed rapidly. As the third allocation of social resources, it has adjusted social contradictions and narrowed the gap between the rich and the poor. It has ensured the steady development of our society. However, problems in philanthropy have been constantly exposed, for example, the internal members of charitable organizations have pocketed charitable resources and so on. These acts of charity corruption have dealt a psychological blow to the public. It dispels the public enthusiasm for charity, and the public is unwilling to donate their money to charity organizations, which seriously affects the healthy development of charitable organizations. Therefore, the importance of charity supervision is becoming increasingly apparent. This paper discusses the concept of charity organization and its supervision, expounds the necessity of perfecting the supervision of charity organization in our country, and discusses the present situation of the supervision of charity organization in our country. This paper points out the problems of the legal supervision of charitable organizations in China. The western countries have a long history of charity supervision. The author mainly combs the research on charity supervision in Britain, the United States and Germany, and sums up the advanced experience and enlightenment. In view of the present situation and existing problems of charity supervision in China, this paper expounds the ways to perfect the supervision of charitable organizations in China. The supervision of charitable organizations has irreplaceable significance for the development of charity in China, and it maintains the rights and interests of stakeholders. It ensures the credibility of charitable organizations, enhances the enthusiasm of the public to participate in charity, provides a good and legal environment for the operation and development of charity, and promotes the development of charitable organizations themselves. At the same time, it is of great significance to promote the further development of China's regulatory system reform and to build a harmonious society.
