负面清单管理模式法律问题研究

【摘要】：负面清单管理模式作为当前国际政治经济领域的热门话题,在国际经贸往来中占用重要地位。本文将着重针对国际投资贸易领域的负面清单管理模式加以讨论。在国际投资贸易领域,负面清单管理模式最早的实践是1834年德意志关税同盟中关于某些特殊商品的“例外情况”规定。在经历了从“例外情况”-“概括否定列举”-“限制行业清单”-“体系化限制行业清单”的发展形式之后,负面清单管理模式已日臻完善,成为国际双边或多边投资协定的重要内容。负面清单管理模式与正面清单管理模式相反,反映的是“法无禁止即可为”的法理理念,并与准入前国民待遇联系密切,共同发挥作用。我国吸收他国先进经验,根据自身实际情况,在特别设立的自由贸易试验区内展开了相关探索。经过一段时间的探索,我国国务院于2015年公布了适用于多家自由贸易试验区的负面清单,这标志着负面清单管理模式在我国逐步进入了探索深水区。同时,我国负面清单管理模式也暴露出法律依据不足、内容措施不透明、相关标准认定滞后以及监管执行力度不足等问题。本文在探索这些问题的基础上,力求提出合理的解决问题建议,为促进负面清单管理模式在我国的发展和进步贡献绵薄之力。
[Abstract]:As a hot topic in the field of international politics and economy, the management mode of negative list occupies an important position in international economic and trade exchanges.This paper will focus on the negative list management model in the field of international investment and trade.In the field of international investment and trade, the earliest practice of negative list management is the "exception" of certain special commodities in the German Customs Union in 1834.After experiencing the development form of "exception", "general negative enumeration", "restricted industry list" and "systematized restricted industry list", the management mode of negative list has been improved day by day.It has become an important part of international bilateral or multilateral investment agreements.The negative list management mode is contrary to the positive list management mode, which reflects the legal principle of "no prohibition of law can be", and is closely related to the national treatment before admission and plays a joint role.China absorbs the advanced experience of other countries, according to its own actual situation, has launched the related exploration in the specially set up free trade experimental area.After a period of exploration, the State Council of our country published a negative list suitable for many free trade test areas in 2015, which indicates that the management mode of negative list has gradually entered the deep water exploration area in our country.At the same time, the negative list management mode of our country also exposes the legal basis insufficiency, the content measure is not transparent, the related standard confirmation lags behind, and the supervision and enforcement strength is insufficient and so on.On the basis of exploring these problems, this paper makes every effort to put forward reasonable suggestions to solve the problems, so as to contribute to the development and progress of the negative list management mode in our country.
