信息化条件下国家秘密信息的法律保护

【摘要】：随着信息技术日新月异的变革和网络全球化的高速发展,世界已经进入了信息化与网络化时代。信息时代的到来对全球各国都产生了深远的影响,随着信息化的发展,信息安全在国家整体安全中的地位也日益突出,正逐步成为国家安全中的核心因素。在网络时代,由于互联网的开放性、脆弱性和无国界性,导致对我国国家信息安全的保障难度大大增加。如果国家的网络系统不安全,信息资源不能被有效保护,则将严重威胁国家的整体安全与发展。在复杂的全球政治经济环境下,我国所面临的信息安全威胁有不断增长的趋势。因此,加强对我国信息安全保密问题的研究,从而实行完善有效的安全问题解决对策是十分必要的。本文首先研究了信息化的概念及基本发展趋势和国家秘密信息的概念与特征、信息化条件下国家秘密信息的表现形式,在此基础上分别从信息化导致国家秘密信息保密管理措施变化、信息化导致国家秘密信息保密管理技术变化、信息化导致国家秘密信息保密管理方式变化等三个方面探讨了信息化条件对国家秘密信息保护的影响；在研究了美国、俄罗斯、法国等典型国家的信息安全保密战略和国家秘密信息保护的法律规定等国外信息化下国家秘密信息保护法律制度后,探讨了信息化条件下我国的国家秘密信息保护立法现状、信息化环境下国家秘密信息保护的主要法律规定和我国国家秘密信息保护存在的法律问题,指出在我国完善信息化条件下的法律制度势在必行,并就完善信息化条件下信息安全保密的立法取向、加强信息保密的法制建设、严把上网信息审查关、完善保密监督检查机制、促进技术的支持和运用、健全涉密人员管理规范和开展保密宣传教育以提高思想认识等七个方面提出了具体完善措施。
[Abstract]:With the rapid change of information technology and the rapid development of network globalization, the world has entered the era of information and networking.With the development of information technology, the status of information security in the whole national security has become increasingly prominent, and it is gradually becoming the core factor in the national security.In the network age, the openness, fragility and borderless nature of the Internet have greatly increased the difficulty of guaranteeing the national information security in our country.If the national network system is not secure and the information resources can not be effectively protected, the overall security and development of the country will be seriously threatened.In the complex global political and economic environment, the threat of information security faced by China has a growing trend.Therefore, it is necessary to strengthen the research on information security and secrecy in our country, so as to perfect and solve the effective security problems.This paper first studies the concept and basic development trend of informatization, the concept and characteristics of state secret information, the manifestation of state secret information under the condition of informatization.On this basis, respectively, informatization leads to changes in the measures of state secret information secrecy management, and informatization leads to changes in state secret information secrecy management technology.This paper discusses the influence of information conditions on the protection of state secret information from three aspects, such as the change of the management mode of state secret information secrecy, and the study of the United States, Russia,After the information security strategy of the typical countries such as France and the legal provisions on the protection of state secret information in foreign countries, such as the legal system of national secret information protection under the information technology, this paper discusses the current situation of the legislation on the protection of state secret information in our country under the condition of information technology.This paper points out that it is imperative to perfect the legal system of state secret information protection in our country under the condition of information environment and the main legal provisions of the protection of state secret information and the legal problems existing in the protection of state secret information in our country.And in order to perfect the legislative orientation of information security and confidentiality under the condition of information, strengthen the legal construction of information secrecy, strictly check the information on the Internet, perfect the mechanism of confidential supervision and inspection, and promote the support and application of technology,Seven aspects, such as perfecting the management standard of secret personnel and carrying out secret propaganda and education to raise ideological awareness, are put forward.
