清代国家法对黔东南少数民族习惯法的影响研究

【摘要】：习惯法是中华法系重要的组成部分,少数民族习惯法是中国习惯法体系中内容最丰富、影响最大的一种习惯法,它对当今的少数民族地区仍有重大影响,在我国法治现代化建设过程中,习惯法的影响不容忽视。这个问题由此也成为学术界的研究热点,法理学、法律史学、社会学、人类学、民族学等领域的学者都有相关的研究成果。本文重点分析清代国家法对黔东南少数民族习惯法的影响,在时间上限定在清代、在空间上限定为黔东南少数民族地区,通过分析清代国家法在黔东南少数民族地区的引入和适用、黔东南少数民族地区百姓对国家法的自主选择,总结出国家法影响黔东南少数民族习惯法的两种途径。再通过比较清代国家法引入黔东南少数民族地区前后少数民族习惯法的变化,总结出清代黔东南少数民族习惯法在国家法影响下的变化。正文包括清代国家法在黔东南少数民族地区的实施、清代国家法影响黔东南少数民族习惯法的途径、清代国家法影响黔东南少数民族习惯法的表现三个部分,共四万多字。清代国家法在黔东南少数民族地区的实施主要论述了清代国家法在黔东南少数民族地区的引入和施行。首先对清代黔东南少数民族地区的政治、经济、文化背景进行回溯;其次从静态的层面从行政制度、刑事制度、民事制度、司法制度四个方面描述了清代引入黔东南少数民族地区的国家法;再次,从动态的层面描述清代国家法在黔东南少数民族地区的实际施行状态。清代国家法影响黔东南少数民族习惯法的途径包括在中央主导下的被动接受、黔东南少数民族地区百姓的自主改变两个部分,一种是中央王朝主导下的改变,这是被动的接受;一种是黔东南少数民族百姓自主的改变,这是主动的适应。两种方法共同构成了清代国家法影响黔东南少数民族习惯法的主要途径。清代国家法影响黔东南少数民族习惯法的表现是分析清代国家法影响黔东南少数民族习惯法的表现,分别从法律表现形式、刑事法律、民事法律、纠纷解决机制、基层社会组织法五个方面进行论述。
[Abstract]:The customary law is an important part of the Chinese legal system, and the customary law of ethnic minorities is the most abundant and influential customary law in the Chinese customary law system. In the process of modernization of rule of law in China, the influence of customary law can not be ignored. This problem has also become a hot topic in academic circles. Scholars in jurisprudence, legal history, sociology, anthropology, ethnology and other fields all have related research results. This paper focuses on the analysis of the influence of the state law of the Qing Dynasty on the customary law of the ethnic minorities in the southeast of Guizhou. The time limit is limited to the Qing Dynasty, and the upper limit of space is defined as the minority area in the southeast of Guizhou. Based on the analysis of the introduction and application of the state law in the minority areas of the southeast of Guizhou, the independent choice of the national law in the minority areas of the southeast of Guizhou was analyzed, and two ways of influencing the customary law of the minority nationalities in the southeast of Guizhou were summarized. By comparing the changes of minority customary law before and after the introduction of the State Law in the Qing Dynasty, this paper summarizes the changes of the customary Law of the ethnic minorities in the Southeast of Guizhou under the influence of the State Law in the Qing Dynasty. The text includes the implementation of the state law of Qing Dynasty in the minority areas of southeast Guizhou, the ways that the state law of the Qing Dynasty affects the customary law of the ethnic minorities in the southeast of Guizhou, and the performance of the state law of the Qing Dynasty affecting the customary law of the minority nationalities in the southeast of Guizhou, with a total of more than 40,000 words. The implementation of the state law in the minority areas of southeast Guizhou mainly discusses the introduction and implementation of the state law in the minority areas in the southeast of Guizhou. First of all, the political, economic and cultural background of the ethnic minority areas in the southeast of Guizhou was traced back to the Qing Dynasty; secondly, from the static level, the administrative system, the criminal system, the civil system, Four aspects of the judicial system described the introduction of the Qing Dynasty into the southeast of Guizhou minority areas of the state law; again, from the dynamic level described the state of the Qing Dynasty in the actual implementation of the national law in the southeast of Guizhou minority areas. The influence of the state law of Qing Dynasty on the customary law of ethnic minorities in the southeast of Guizhou includes passive acceptance under the guidance of the central government, and the independent change of the people in the minority areas of the southeast of Guizhou, one is the change under the leadership of the central dynasty, which is the passive acceptance; One is the autonomous change of the minority people in the southeast of Guizhou, which is an active adaptation. The two methods together constitute the main ways of influencing the customary law of ethnic minorities in the southeast of Guizhou by the state law of the Qing Dynasty. The manifestation of the influence of the state law of Qing Dynasty on the customary law of ethnic minorities in the southeast of Guizhou is to analyze the expression of the state law of the Qing Dynasty affecting the customary law of the ethnic minorities in the southeast of Guizhou, respectively from the legal manifestation, the criminal law, the civil law, the dispute resolution mechanism.
