简阳市涉诉信访制度改革的案列研究

【摘要】：在新时代的中国,社会、政治、经济、文化等各个方面得到快速发展,并取得喜人的成绩。但与此同时,社会经济快速发展使社会矛盾更加尖锐和难以调和,甚至已经羁绊住社会主义建设的脚步,影响到社会稳定,不利于和谐社会的构建。自2004年以来,逐级访、越级访、重复访和集体访等非访频率开始大幅度上升,司法的权威性被弱化。因此,涉诉信访问题的合理解决具有重要意义,它是人民群众当家做主、依法管理国家事务和享受公民权利的前提,是公民维护合法权益的法律保障,能为国家这部大机器正常运作营造良好的政治环境。本文以公共管理中公共政策的制定和政府作用相关理论为基础,首先阐述了涉诉信访的研究背景和目的,对中外涉诉信访制度发展情况进行比对,辨析信访及涉诉信访相关概念。然后以简阳市涉诉信访制度现状为例,从简阳市涉诉信访制度改革的背景、基本情况来分析简阳市涉诉信访制度改革的基本情况和存在的问题。在从简阳市涉诉信访制度改革中处理机制构建和责任主体两个关键因素来进行分析。最后结合自身实际和国情来对简阳市完善涉诉信访制度提出相应的对策。使涉诉信访制度时限最终的现实意义,即降低社会管理成本、提高工作效率、平衡各群体利益、维护社会稳定、构建社会和谐。
[Abstract]:In the new era of China, social, political, economic, cultural and other aspects of rapid development, and achieved gratifying results. But at the same time, the rapid development of social economy makes the social contradictions more sharp and difficult to reconcile, even has fettered the pace of socialist construction, affecting social stability, is not conducive to the construction of a harmonious society. Since 2004, the frequency of non-visits, such as graded visits, leapfrogging visits, repeated visits and collective visits, has been greatly increased, and the judicial authority has been weakened. Therefore, it is of great significance to solve the problem of petition, which is the prerequisite for the people to be the master of their own country, to manage the affairs of the state and enjoy the civil rights according to law, and the legal guarantee for citizens to safeguard their legitimate rights and interests. To create a good political environment for the normal operation of the country's big machine. Based on the relevant theories of public policy formulation and the role of government in public administration, this paper first expounds the background and purpose of the research on complaint letters and visits, and compares the development of complaint letters and visits system between China and foreign countries. Discriminating and analyzing the related concepts of petition and complaint petition. Then taking the current situation of the system of petition and petition in Jianyang as an example, this paper analyzes the basic situation and existing problems of the reform of the system of petition and petition in Jianyang from the background of the reform of the system of petition and petition in the city of Jianyang. This paper analyzes the two key factors in the reform of the system of complaint, petition and complaint in Jianyang City, namely, the construction of handling mechanism and the subject of responsibility. Finally, the author puts forward the corresponding countermeasures to improve the system of complaint petition in Jianyang City according to its own reality and national conditions. The final practical significance of the time limit of the system is to reduce the cost of social management, improve the work efficiency, balance the interests of all groups, maintain social stability and build social harmony.
