后签证时代海事监管对策研究

【摘要】：从宋朝开始存在的船舶签证,在中国存续了一千多年,终于被简政放权的大潮带走了,船舶签证起着航次信息采集,适航性检查,规费征稽监管的作用,在事前审批的昨天有着举足轻重的地位,但在简政放权的今天,监管模式由事前监管转为事中事后监管,海事监管由动静态监管并重转为动态监管为主、静态监管为辅,船舶签证已不适应服务型政府的发展规律,研究签证取消后的海事监管新对策迫在眉睫。本文从公共管理学角度出发,基于服务型政府理论,以行政管理体制改革为指导,突出海事监管效能的提高和海事公共服务的供给,坚持“以人为本,优质服务”的原则,对海事监管新对策进行了研究。首先,分析了国内外签证取消后海事监管对策的研究现状,对船舶签证、深化行政管理体制改革、简政放权的大背景进行了介绍,确立了服务型政府理论为本文的理论基础;然后,分析了船舶签证取消当下,海事安全监管现状及存在的问题;接下来,研究先进国家(地区)的海事监管模式,通过比较研究得出经验借鉴,总结分析出服务型政府对海事监管对策的要求;最后,吸收先进国家(地区)的海事监管经验,结合我国社会发展实际,给出了签证取消后海事监管的思路和对策。本文旨在为签证取消后海事监管对策指明方向,提供借鉴,以期能够实现航行更安全,海洋更清洁的目标,使海事事业又好又快的发展。
[Abstract]:The ship visa, which began to exist in the Song Dynasty, lasted for more than a thousand years in China, and was finally taken away by the tide of decentralization. The ship visa acts as a means of collecting voyage information, checking seaworthiness, and supervising the collection of fees. Yesterday, prior examination and approval played an important role. But today, with the decentralization of government power, the mode of supervision has changed from pre-supervision to post-event supervision, and maritime supervision has changed from dynamic and static supervision to dynamic supervision, supplemented by static supervision. The ship visa has not adapted to the development rule of the service government, so it is urgent to study the new countermeasure of maritime supervision after the cancellation of the visa. From the angle of public management, based on the theory of service-oriented government and guided by the reform of administrative management system, this paper emphasizes the improvement of maritime supervision efficiency and the supply of maritime public service, and adheres to the principle of "people-oriented and high-quality service". The new countermeasures of maritime supervision are studied. First of all, it analyzes the research status of maritime supervision after visa cancellation at home and abroad, introduces the background of ship visa, deepening the reform of administrative system and simplifying the power of administration, and establishes the theory of service-oriented government as the theoretical basis of this paper. Then, it analyzes the current situation and existing problems of maritime safety supervision. Then, it studies the maritime supervision model of advanced countries (regions), and draws lessons from the comparative study. This paper summarizes and analyzes the requirements of the service-oriented government for maritime supervision and regulations, and finally, absorbs the maritime supervision experience of advanced countries (regions) and combines the social development reality of our country, and puts forward the ideas and countermeasures of maritime supervision after visa cancellation. The purpose of this paper is to point out the direction of maritime supervision and control after visa cancellation, and to provide reference to realize the goal of safer navigation and cleaner ocean, so as to make the maritime industry develop well and quickly.
