【摘要】： 本文是从犯罪心理学角度研究警察职务犯罪预防的专题论文,结合警察行业的特殊性提出了犯罪心理学的警察职务犯罪概念,并通过深入分析警察职务犯罪的现状、发展趋势以及心理结构和形成过程,提出了警察职务犯罪心理预防的框架,对于我国深化警察职务犯罪预防具有一定的理论意义和实践价值。全文分为三章。第一章从职务、职务犯罪的概念推导出刑法学视角和犯罪学视角的警察职务犯罪概念,创造性地提出了犯罪心理学视角的警察职务犯罪概念,并梳理了警察职务犯罪与警察腐败的区别和联系。同时,通过近几年的数据分析了警察职务犯罪的现状,主要有领导干部职务犯罪问题比较突出、警察职务犯罪形式呈多样化、渎职侵权类职务犯罪案件居高不下等特点,并预测了警察职务犯罪将在一定时期内存在,其数量和比例在一个较长的时期内呈上升趋势,以权谋私、权钱结合、权钱交易将成为警察职务犯罪的典型形式以及警察职务犯罪具有起伏性,呈波浪式发展态势的发展趋势。第二章分为二小节,第一节主要从警察职务犯罪心理的本质、警察职务犯罪心理的特性、警察职务犯罪心理的表现形式三个方面对警察职务犯罪心理进行了分析。第二节主要阐述了警察职务犯罪心理的形成,一是从警察角色冲突因素、警察文化中消极因素的影响、警察情绪调节能力与应激水平、心理环境与不同意识层次的作用四个方面论述了影响警察职务犯罪心理形成的因素,二是从故意警察职务犯罪心理、过失警察职务犯罪心理两个方面对警察职务犯罪心理的形成进行了分类。第三章论述了警察职务犯罪的心理预防。首先从警察职务犯罪的一般心理预防、对某些可能形成职务犯罪心理的警察实施的特殊心理预防、对已经形成职务犯罪心理的警察实施的特殊心理预防三个层次阐述了警察职务犯罪心理预防的涵义;其次分析了警察职务犯罪心理预防具有内因预防性、过程阻断性两种特性;最后主要从优化心理环境,减弱外界对警察职务犯罪的诱惑力;改善心理结构,增强警察个体对职务犯罪的免疫力;加强监督矫治,促使警察职务犯罪心理结构的弱化三个方面提出了警察职务犯罪心理预防的措施。
[Abstract]:This paper studies the crime prevention of police duty from the angle of criminal psychology, and puts forward the concept of police duty crime in the light of the particularity of the police profession. And through in-depth analysis of the present situation, development trend, psychological structure and formation process of police duty crime, the paper puts forward the framework of psychological prevention of police duty crime. It has certain theoretical significance and practical value for deepening the prevention of police duty crime in our country. The thesis is divided into three chapters. The first chapter deduces the concept of police duty crime from the perspective of criminal law and criminology, and creatively puts forward the concept of police duty crime from the perspective of criminal psychology. At the same time, through the data of recent years, the paper analyzes the present situation of the police duty crime, mainly has the leading cadre duty crime question to be more prominent, and combs the police duty crime and the police corruption difference and the connection, at the same time, through the recent data analysis police duty crime present situation. The form of police duty crime is diversified, the malfeasance type of duty crime cases remain high, and it is predicted that the police duty crime will exist in a certain period. Its quantity and proportion in a long period of time show an upward trend, power for personal gain, power and money combination, power and money transaction will become a typical form of police duty crime and police duty crime with ups and downs. The second chapter is divided into two sections, the first section mainly from the nature of police duty crime psychology, the characteristics of police duty crime psychology. The second section mainly expounds the formation of the police duty crime psychology, first, from the police role conflict factors. The influence of negative factors in police culture, the ability of police emotion regulation and the level of stress, the role of psychological environment and different levels of consciousness are discussed. The second is from the intentional police duty crime psychology. The formation of police duty crime psychology is classified in two aspects. The third chapter discusses the psychological prevention of police duty crime. Firstly, it discusses the general psychological prevention of police duty crime. The special psychological prevention for some policemen who may form the psychology of duty crime and the special psychological prevention for the police who have formed the psychology of duty crime are expounded the meaning of the psychological prevention of the duty crime of the police. Secondly, it analyzes that the psychological prevention of police duty crime has two characteristics: the prevention of internal cause and the interdiction of process. Finally, mainly from the optimization of the psychological environment, to reduce the temptation of the outside to the police duty crime; To improve the psychological structure and enhance the immunity of individual police to duty crime; Strengthening supervision and correction, promoting the weakening of the psychological structure of police duty crime, three aspects of the police duty crime psychological prevention measures are put forward.
