【摘要】： 自古以来,少年犯罪都是一个严重的社会问题,少年犯罪给社会造成的危害是巨大的,人类历来注重对少年犯罪的治理。但由于少年是智力和体力都没有充分发育的时期,少年也是社会上的弱势群体,同时少年又具有很大的可塑造性,因此,在对少年犯罪的处罚方面,往往采取与成年犯罪相区别的方式,这就体现在少年犯罪的刑事政策上。本文拟就我国现行少年刑事政策的具体内容及少年刑事政策的历史变迁进行系统研究和梳理,并就我国少年刑事政策中出现的问题作实证性考察和研究。从我国对少年犯罪和少年自身生长发育过程中生理和心理的特点引发出对待少年刑事政策的一点思考。本文分为以下四个部分: 第一章对少年刑事政策的概念进行了界定,然后对少年刑事政策与一般刑事政策的不同进行了阐述。最后概括了少年刑事政策的理论基础。第二章介绍了新中国成立以来我国少年刑事政策的历史变迁。分三个阶段:建国到1984年第一个少年法庭的建立为我国少年刑事政策诞生和曲折发展时期;1984年到90年代中期,为我国少年刑事政策快速发展的阶段;90年代到现在,是我国少年刑事政策完善时期。随后介绍了少年刑事政策演变的规律性。第三章阐述了我国少年刑事政策的主要内容。我国的少年刑事政策主要包括对少年犯罪实行综合治理、“教育、感化、挽救”、“教育为主、惩罚为辅”、双保护原则、相称原则、预防为主、减少司法干预的原则以及少年宜教不宜罚。第四章指出我国少年刑事政策的内容现在存在的问题,并针对我国少年刑事政策存在的缺陷提出完善意见,以求促进我国少年刑事政策的发展。第五章是结语部分,对我国的少年刑事政策提出建议和期望,以更好的治理我国的少年犯罪问题。
[Abstract]:Since ancient times, juvenile delinquency is a serious social problem, the harm caused by juvenile delinquency to the society is enormous, and mankind has always paid attention to the management of juvenile delinquency.However, since juveniles are not fully developed in intelligence and physical strength, juveniles are also a vulnerable group in society, and at the same time juveniles have a great degree of mouldability, so, in the area of punishment for juvenile delinquency,It is often different from adult crime, which is reflected in the criminal policy of juvenile delinquency.This paper intends to make a systematic study on the specific contents of the current juvenile criminal policy and the historical changes of the juvenile criminal policy, and make an empirical investigation and study on the problems arising in the juvenile criminal policy of our country.From the characteristics of physiology and psychology in the process of juvenile delinquency and juvenile growth and development in our country, some thoughts on the criminal policy towards juveniles are given.This paper is divided into the following four parts:The first chapter defines the concept of juvenile criminal policy, and then expounds the difference between juvenile criminal policy and general criminal policy.Finally, it summarizes the theoretical basis of juvenile criminal policy.The second chapter introduces the historical changes of juvenile criminal policy since the founding of New China.It is divided into three stages: the establishment of the first juvenile court from the founding of the people's Republic of China to the establishment of the first juvenile court in 1984 was the period of birth and tortuous development of our country's juvenile criminal policy, and the period from 1984 to the middle of the 1990s was the period of rapid development of our country's juvenile criminal policy.Is our country juvenile criminal policy consummation period.Then it introduces the law of the evolution of juvenile criminal policy.The third chapter expounds the main contents of juvenile criminal policy in China.Our country's juvenile criminal policy mainly includes comprehensive management of juvenile delinquency, "education, probation, rescue", "education as the main, punishment as the secondary", the principle of double protection, the principle of proportionality, and the principle of prevention.The principle of reducing judicial intervention and juvenile education should not be punished.The fourth chapter points out the problems existing in the content of juvenile criminal policy in our country, and puts forward some suggestions to promote the development of juvenile criminal policy.The fifth chapter is the conclusion part, puts forward the suggestion and the expectation to our country's juvenile criminal policy, in order to better manage our country's juvenile delinquency problem.
