社区矫正制度的本土化完善

【摘要】： 世界刑罚制度的创新需要用最有效、最人道、最文明的方式处理犯罪和犯罪人，社区矫正就是契合这一发展而产生的刑罚方式。为适应国际形势，2003年，我国下发了《关于开展社区矫正试点工作的通知》，改革和完善我国原有的社区矫正制度。从现行刑罚制度来看，我国的社区矫正有自己的体系和特色，但与国外相比，社区矫正的整体制度需要改革和重新构建。为此，笔者想通过对国外社区矫正理念、种类、制度等的借鉴；通过对我国目前试点地区社区矫正刑罚执行情况的分析与评价，，并且参考当地的一些做法，探讨社区矫正制度在理念、立法、执行措施、管理体制方面的完善，以期对我国今后社区矫正的实际开展有所推动。
[Abstract]:The innovation of the world penalty system needs to deal with the crime and the criminal in the most effective, humane and civilized way. In order to adapt to the international situation, in 2003, our country issued the notice on the pilot work of Community Correction, which reformed and improved the original community correction system in China. From the point of view of the current penalty system, the community correction in our country has its own system and characteristics, but compared with foreign countries, the whole system of community correction needs to be reformed and rebuilt. Therefore, the author wants to draw lessons from the ideas, types and systems of community correction in foreign countries, and through the analysis and evaluation of the implementation of community correction penalties in the pilot areas of China at present, and refer to some local practices. This paper probes into the perfection of community correction system in the aspects of concept, legislation, executive measures and management system, in order to promote the actual development of community correction in China in the future.
