犯罪学视域中的大学生犯罪问题研究

【摘要】： 大学生是我国国民中的高学历、高素质群体,他们的主流是健康、积极、向上的,大学生群体是我国未来发展的砥柱和希望。但是,近几年随着我国新旧体制的转轨、市场经济的发展以及高等教育体制的改革,大学生犯罪案件频频发生,人数急剧增加,手段逐步升级,引起社会各界的广泛关注。本人通过调研分析,从犯罪学的视角,总结大学生犯罪的现状、原因、对策,并借鉴国外相关的大学生犯罪预防对策,提出我国遏制大学生犯罪的司法对策的完善构想。第一章,大学生犯罪的理论界定及法律现状。第一节,首先界定本文所指的“大学生”概念,即狭义上国家统招的全日制在校大学生,包括大学专科生、本科生、硕士研究生、博士研究生等。其次,明确“大学生犯罪”的概念,即指在校大学生所实施的具有一定的社会危害性、触犯刑律并应受到刑罚处罚的行为。这个定义重点突出了犯罪主体为在校大学生这一特征。第二节,大学生犯罪的现状及特点分析。多项数据表明,当前我国大学生犯罪案件呈直线上升态势,上升速度令人触目惊心。大学生犯罪主要呈现出以下特点:其一,从数量上看,大学生犯罪总量不断上升,范围不断扩大;其二,从类型上看,侵财型、暴力型犯罪增长突出;其三,从规律上看,大学生犯罪有一定的时间性、地域性和突发性;其四,从性别上看,女大学生犯罪人数逐渐增加。第二章,大学生犯罪的主要原因。从外因、内因两个方面分析。外因方面,首先阐述家庭因素,包括残缺家庭、问题家庭、贫困家庭对大学生犯罪的影响;其次学校因素,包括应试教育的弊端、法制教育欠缺、管理存在漏洞等等;最后为社会因素,分别从政治、经济、文化三个方面阐述社会因素与大学生犯罪的联系。内因方面,分别从生理、心理两个层面分析大学生犯罪现象产生的内在原因。第三章,大学生犯罪的域外考察。首先介绍国外大学生犯罪的现状。通过数据表明当前国外大学生犯罪普遍呈上升态势。其次,考察国外大学生犯罪预防的经验。主要借鉴美国、英国、日本、德国四个国家各具特色的大学生犯罪预防经验,以及对我国的大学生犯罪预防工作的启示和指导。第四章,我国预防大学生犯罪的司法对策现状及缺陷分析。第一部分重点介绍当前我国预防大学生犯罪的对策现状:各部门高度重视,加强研究;一批预防机构相继成立;社区警务进入大学校园;司法治理更趋人性化。第二部分通过调查发现我国预防大学生犯罪的司法对策仍存在缺陷,分别从学校、家庭、社会等方面对这些缺陷予以阐述。第五章,遏制大学生犯罪的司法对策的改革与完善。主要从学校预防、家庭预防、社会预防以及大学生犯罪的司法矫治四个方面提出遏制大学生犯罪的司法对策的完善构想。
[Abstract]:College students are the high education and high quality groups in our country. Their mainstream is healthy, positive and upward. The college students are the future development of our country. However, in recent years, with the transition of new and old system, the development of market economy and the reform of higher education system, the crime cases of college students have occurred frequently, the number of students has increased sharply, and the means have been gradually upgraded, which has caused widespread concern from all walks of life. Through investigation and analysis, from the perspective of criminology, I sum up the current situation, reasons, countermeasures of college students' crime, and draw lessons from foreign related crime prevention measures of college students. The first chapter is the definition of the theory of college students' crime and the current situation of the law. In the first section, we define the concept of "college students", that is, full-time college students, including junior college students, undergraduate students, master students, doctorate students and so on. Secondly, it is clear that the concept of "college student crime" refers to the behavior of college students which has certain social harmfulness, violates the criminal law and should be punished by penalty. This definition highlights the feature that the subject of the crime is a college student. The second section, the university student crime present situation and the characteristic analysis. A number of data show that the crime cases of college students in our country are rising in a straight line, and the rising speed is shocking. The main characteristics of college students' crimes are as follows: first, in terms of quantity, the total amount of crimes of college students is rising and the scope is constantly expanding; second, in terms of types, the growth of crimes of invading wealth and violent crimes is prominent; thirdly, in terms of laws, The crime of college students has a certain time, regional and sudden; fourth, from the gender point of view, the number of female college students has gradually increased. Chapter two, the main reasons for college students to commit crimes. From external causes, internal causes of two aspects of analysis. In terms of external causes, the author first expounds the influence of family factors on college students' crime, including incomplete families, problem families and poor families, secondly, the school factors, including the malpractice of exam-oriented education, the lack of legal education, the loopholes in management, and so on. Finally, social factors, from the political, economic and cultural aspects of the relationship between social factors and college students crime. In terms of internal causes, the internal causes of the phenomenon of college students' crime are analyzed from the physiological and psychological aspects. Chapter three, the extraterritorial investigation of college students' crimes. First of all, it introduces the current situation of college students' crime abroad. The data show that the crime of college students abroad is on the rise. Secondly, investigate the experience of crime prevention of foreign college students. The paper mainly draws lessons from the experiences of the United States, the United Kingdom, Japan and Germany in the prevention of college students' crimes, as well as their enlightenment and guidance for the prevention of college students' crimes in China. Chapter four, The present situation and defect analysis of judicial countermeasures to prevent college students' crime in China. The first part focuses on the current situation of countermeasures to prevent college students' crime in China: all departments attach great importance to strengthen research; a number of prevention institutions have been set up; Community policing into the university campus; judicial governance more humanized. The second part through the investigation found that there are still defects in the judicial measures to prevent college students' crime, respectively from the school, family, society and other aspects to elaborate these defects. Chapter five, the reform and improvement of the judicial countermeasures to curb the university students' crime. From four aspects of school prevention, family prevention, social prevention and judicial correction of college students' crimes, the author puts forward the perfect conception of judicial countermeasures to curb college students' crimes.
