激情犯罪生成机理及其防控机制研究

【摘要】： “激情犯罪”(crime by passion)是行为人在外界重大刺激所造成的强烈而短暂的消极激情支配下实施的爆发性、冲动性的犯罪行为,具有行为状态的突发性、行为表象的公开性、意识状态的模糊性、行为后果的严重性等特征。激情犯罪具有严重的社会危害性,但就目前的状况来看,我们的理论研究还略显单薄,司法事务中亦存在诸多问题和不足。本文尝试从激情犯罪概念界定入手,研究激情犯罪生成的内外因双重诱发机制,并从犯罪预防、刑罚裁量和罪犯矫正三个层面对激情犯罪的防控工作提出了若干意见和建议。本文除了导言和结语之外,主体内容分为三大部分: 第一部分为激情犯罪概念和特征介绍。首先是对激情犯罪进行了准确的概念界定,分析了激情犯罪的显著特征;针对激情犯罪概念界定中的含混不清,又着重区分了三组概念:激情犯罪与一般预谋性犯罪、激情犯罪与情绪犯罪、激情犯罪与消极心境犯罪。第二部分为激情犯罪生成机制分析。激情犯罪人内在心理缺陷与所遭受的外界不良环境刺激的结合导致了激情犯罪的发生。激情犯罪人内在心理缺陷(集中表现为偏激狭隘的认知水平、消极的情绪情感品质、薄弱的意志力)是激情犯罪行为生成的主观依据,外界不良刺激则是激情犯罪行为生成的客观条件。再进一步来看,社会发展失衡、家庭和学校教育不当、不良文化的侵蚀则是诱发激情犯罪人内在心理缺陷的深层社会原因。第三部分为激情犯罪防控机制研究。对激情犯罪人的防控工作包括犯罪预防、刑罚裁量和罪犯矫正三大有机结合、不可或缺的板块。鉴于激情犯罪内外因双重诱发机制,以及青少年激情犯罪的严重社会危害性,应兼顾社会环境和个体心理两个层面开展犯罪防范工作,并对青少年采取特殊的防范措施;激情犯罪因情感的突出作用而有别于一般预谋性犯罪,对激情犯罪人减轻处罚符合罪刑相当基本原则的要求,也是社会防卫的客观需要;以激情犯罪人的易矫正性为契机,深入了解激情犯罪人的犯罪成因及行为背后难言的苦衷,以情动人,循序渐进,矫正其不良心理缺陷,使激情犯罪人改造效果呈现质的飞跃成为可能。
[Abstract]:"Passion Crime" (crime by passion) is an explosive and impulsive criminal act carried out by the actor under the influence of strong and short negative passion caused by the great external stimulation. It has the characteristics of sudden behavior and public behavior appearance. The fuzziness of the state of consciousness and the seriousness of the consequences of behavior. The crime of passion has serious social harmfulness, but in the present situation, our theoretical research is still weak, and there are many problems and deficiencies in the judicial affairs. This paper attempts to define the concept of passion crime, studies the internal and external causes of passion crime, and puts forward some opinions and suggestions on the prevention and control of passion crime from three aspects: crime prevention, penalty discretion and criminal correction. In addition to the introduction and conclusion, the main content is divided into three parts: the first part is an introduction to the concept and characteristics of crime of passion. First of all, it defines the concept of passion crime accurately, analyzes the prominent characteristics of passion crime, and focuses on distinguishing three groups of concepts: passion crime and general premeditated crime, in view of the ambiguity in the definition of passion crime, and focuses on distinguishing three groups of concepts: passion crime and general premeditated crime. Crime of passion and crime of emotion, crime of passion and crime of negative mood. The second part is the analysis of the generating mechanism of the crime of passion. The combination of the psychological defects of the passion offender and the external unfavorable environment leads to the occurrence of the passion crime. The subjective basis for the creation of the crime of passion is the intrinsic psychological defects (concentrated in extreme and narrow cognitive level, negative emotional quality, weak willpower). The external bad stimulation is the objective condition of the crime of passion. Furthermore, the imbalance of social development, improper family and school education, and the erosion of bad culture are the deep social reasons that induce the inner psychological defects of the passionate criminals. The third part is the research on the mechanism of crime prevention and control. The prevention and control of passionate criminals includes crime prevention, penalty discretion and criminal correction. In view of the dual inducing mechanism inside and outside the crime of passion and the serious social harm of the crime of passion, we should take into account the social environment and individual psychology to carry out the crime prevention work, and take special preventive measures to the young people; The crime of passion is different from the general premeditated crime because of the prominent role of emotion. The mitigation of punishment for the offender of passion accords with the basic principle of crime and punishment, and it is also the objective need of social defense. By deeply understanding the causes of crime and the unspeakable difficulties behind the behavior, it is possible to correct its bad psychological defects by moving with emotion and gradually, so as to make it possible for the reform effect of the passionate offender to take on a qualitative leap.
