西方新正义战争理论的发展及其当代争论

【摘要】：新正义战争理论的提出是基于在战后阶段重建和平问题日益突出这一国际现实,该理论通过将战争过程分为开战、交战和战后三个阶段,创造性地提出了"战后正义"的概念及标准,从而突破了传统正义战争理论遵循的"开战正义"和"交战正义"的两分法研究思路,该理论的提出对国际政治和国际法律实践也产生了深远影响,但另一方面,新正义战争理论存在的一些固有缺陷也决定了其仍不能摆脱传统正义战争理论的理想主义框架。
[Abstract]:The theory of new just war is based on the international reality that the problem of re-establishing peace is increasingly prominent in the post-war period. The theory divides the process of war into three stages: war, war and postwar. This paper creatively puts forward the concept and standard of "postwar justice", and breaks through the dichotomy of "war justice" and "belligerent justice", which is followed by the traditional just war theory. The theory has a profound influence on international politics and international legal practice, but on the other hand, some inherent defects of the new just war theory also decide that it can not get rid of the idealistic framework of the traditional just war theory.
