中韩两国间货物陆海联运法律问题研究

【摘要】：中韩两国隔海相望,濒海而邻,地理位置的优势使得两国贸易与经济往来频繁,中国一度成为韩国重要的货物进出口国家。自两国签订《中韩陆海联运汽车货物运输协定》以来,无缝隙衔接的联合运输和高速高效的货物往来进一步促进了两国的经济贸易交流。但值得注意的是,在肯定货物陆海联合运输的优势时,也不能忽视其中存在的问题。自陆海联运开通以来,各种法律问题暴露出来。但是,两国目前多从技术及管理方面研究该种运输方式,法律问题少有涉及,与此相关的国际条约和国际惯例也尚未统一。因此,本文在及时弥补法律漏洞,填补法律空白,对促进中韩两国贸易和海运发展方面具有重要实用意义,在理论上也具有重要的研究价值。本文主要从四个方面进行阐述。一、叙述目前中韩陆海联运的立法概况。从中国国内法,韩国国内法和国际条约与国际惯例三个角度对目前可适用的法律进行梳理。二、中韩陆海联运法律关系研究。本部分主要就陆海联运经营人、货方、海运方和港口货物装卸方之间的关系进行探讨,在研究各方当事人法律关系及权利义务的基础上,指出其面临的法律风险并就该风险的解决提出切实可行的法律对策。三、中韩陆海联运法律适用研究。本部分是根据联运法律纠纷各方当事人经常住所地的不同,分情况探讨纠纷解决过程中可以适用的法律,对存在的风险情况提出建议。四、陆海联运保险问题。分析联运目前的保险法律现状,分析问题并提出解决方案。
[Abstract]:China and South Korea face each other across the sea, adjacent to the sea, the advantage of geographical position makes trade and economic exchanges between the two countries frequent, China once became an important import and export country of South Korea. Since the signing of the Agreement between China and South Korea on the Carriage of Automobile goods by Land and Sea, the seamless joint transport and high-speed and efficient cargo exchanges have further promoted the economic and trade exchanges between the two countries. But it is worth noting that in affirming the advantages of combined transport of goods by land and sea, the existing problems should not be ignored. Since the opening of land-sea transport, various legal problems have been exposed. However, at present, the two countries mainly study this mode of transport from the aspects of technology and management, and the legal issues are seldom involved, and the relevant international treaties and international practice have not yet been unified. Therefore, this paper is of great practical significance for promoting the development of trade and shipping between China and South Korea, and also has important research value in theory. This article mainly carries on the elaboration from four aspects. First, describe the current legislation of land and sea transport between China and South Korea. From three angles of Chinese domestic law, Korean domestic law, international treaty and international practice, the current applicable law is combed. Second, the study of the legal relationship between China and South Korea through land and sea transport. This part mainly discusses the relationship between land and sea transport operators, cargo parties, shipping parties and port cargo loaders, on the basis of the study of the legal relations and rights and obligations of the parties, It points out the legal risk it faces and puts forward practical legal countermeasures to solve the risk. Third, the study on the application of land and sea transport laws between China and South Korea. This part discusses the applicable law in the process of dispute settlement according to the difference of the place of residence of the parties to the dispute, and puts forward some suggestions on the risk situation. Fourth, land-sea combined transport insurance. Analyze the current insurance law of intermodal transport, analyze the problems and propose solutions.
