深圳市宝安区社区治理模式改革研究

【摘要】：党的十八届三中全会明确提出推进国家治理体系和治理能力现代化的总目标,并在四中全会强调要进一步推进基层治理法治化。深圳市于2015年1月9日研究出台《深圳市基层管理体制改革指导意见》,提出制定新机制,形成党委领导、政府负责、社会协同、公众参与、法治保障的基层治理新格局。宝安区作为深圳市原关外的一个大区,研究宝安区社区治理模式改革课题,符合中央、省、市的全面深化改革路线,踏准基层改革步调,能为深圳市的基层管理体制改革提供原始的调研数据以及探索创新的现实参考。近年来,宝安区在社区治理模式创新方面进行了积极探索,经历了“村改居”、“居站分设”、“一站多居”、“政企分开”等一系列社区治理体制改革,但全区社区治理体系和治理能力仍面临一系列突出矛盾和问题,离中央治理体系和治理能力现代化总目标还有相当大的距离,社区治理模式的改革研究还需进一步深化和加强。本文通过宝安区社区治理现实概况以及社区治理模式改革历史沿革的阐述,分析了当前宝安区社区治理主要存在四个方面的问题：第一,社区治理职能划分不清,行政化倾向严重；第二,社区治理载体单一化,居民参与意识薄弱参与度不高,社会组织与非营利组织培育不够等；第三,社区治理能力有所欠缺,现代化和专业化水平有待加强；第四,社区基础发展不均衡,资源配置未达到最优化。针对存在的四个方面问题,笔者进一步加深研究,剖析了导致社区治理面临这些问题的真正原因,原因包括：第一,社区治理理念相对滞后,治理、法治、共治思想不到位；第二,社区治理法律法规及政策的制约；第三,社区治理机制和监管体系不完善。围绕社区治理模式改革路径,笔者查阅研读文献,总结当前国内外社区治理模式；同时,开拓新视野,研究了公共治理、多中心治理、公民治理和新公共服务等理论,在提取多种新治理理论精华的基础上,结合宝安区当前的社区治理现况,提出构建“一核多元”共同治理的“适度自治”社区治理模式,逐步建立现代化的社区治理体系,构建法治和谐的城市社区。
[Abstract]:The third Plenary session of the 18th CPC Central Committee clearly put forward the general goal of promoting the modernization of the national governance system and governance ability, and stressed in the fourth Plenary session of the CPC Central Committee that it is necessary to further promote the rule of law at the grass-roots level. On January 9, 2015, Shenzhen studied and issued the guiding opinions on the reform of the grass-roots management system in Shenzhen, and put forward a new pattern of grass-roots governance with the leadership of the party committee, the responsibility of the government, social cooperation, public participation and the guarantee of the rule of law. Baoan District, as a large area outside the original customs of Shenzhen City, has studied the reform of the community governance model in Baoan District, in line with the central, provincial and municipal lines of comprehensive deepening reform, and has followed the pace of quasi-grass-roots reform. It can provide original research data and practical reference to explore innovation for the reform of basic level management system in Shenzhen. In recent years, Baoan District has actively explored the innovation of community governance model, and has experienced a series of community governance system reforms, such as "changing from village to residence", "setting up separate housing stations", "living in one station more than one station", "separating government from enterprise", and so on. However, the whole district community governance system and ability still face a series of outstanding contradictions and problems, from the central governance system and the overall goal of governance capacity modernization is still a considerable distance, the reform of community governance model research needs to be further deepened and strengthened. This paper analyzes four main problems of community governance in Baoan District through the introduction of the reality of community governance in Baoan District and the history of the reform of community governance mode. Firstly, the function of community governance is not clearly divided. The tendency of administration is serious; second, the carrier of community governance is single, the participation of residents is not high, the cultivation of social organizations and non-profit organizations is not enough, and the ability of community governance is lacking. The level of modernization and specialization needs to be strengthened, fourth, the development of community infrastructure is not balanced, and the allocation of resources is not optimized. Aiming at the four existing problems, the author further studies and analyzes the real reasons that lead to the community governance facing these problems. The reasons include: first, the concept of community governance is relatively lagging, governance, rule of law, the idea of co-governance is not in place; Second, the restriction of laws, regulations and policies of community governance; third, the imperfection of community governance mechanism and supervision system. Around the reform path of community governance model, the author reviews the literature and summarizes the current community governance model at home and abroad. At the same time, the author develops a new vision and studies the theories of public governance, multi-center governance, citizen governance and new public service. On the basis of extracting the essence of many kinds of new governance theories and combining the current situation of community governance in Baoan District, this paper proposes to construct a "moderate autonomy" community governance model of "one core, multiple" common governance, and gradually establish a modern community governance system. Construct harmonious urban community ruled by law.
