从权利到民生——“小区拆围墙”之分析

【摘要】：反对拆除小区围墙最有力的理由在于其会侵犯公民私有财产权,进而开法治倒车。其实不然,拆除小区围墙既有其合理性,又有其合法性。过多的围墙既不利于道路通达,又会人为地隔绝社会性形成和固化阶层壁垒。反对理由之所以不成立,在于不加区别地应用既有权利理论,从而得出非此即彼的对抗性结论。从财产权本质、社会组织结构、中国式权利形成等方面的分析可以发现,很多场合下,民生权可以体现出中国式权利生成内在理路,从而能够更有效回应当下中国政治与社会发展需求。在是否拆除小区围墙的争论中,绝对的财产权保护只会造成不必要的权利对抗,民生权的适用则可以很大程度上避免这些弊端。
[Abstract]:The most powerful reason to oppose the dismantling of residential walls is that it violated the private property rights of citizens and then reverse the rule of law. In fact, it is not only reasonable but also legitimate to dismantle the enclosure walls. Too many walls are not conducive to road accessibility, but also artificially isolate social forms and solidify stratum barriers. The analysis of the nature of property rights, social organization structure and the formation of Chinese rights can be found from the nature of property rights, social organization structure and the formation of Chinese rights. In many cases, the right of people's livelihood can reflect the internal logic of Chinese rights, which can be more effective in responding to the current Chinese politics. In the debate on whether to dismantle the enclosure of the community, the protection of the absolute property rights will only cause unnecessary rights and confrontation, and the application of the right to the people's livelihood can largely avoid these drawbacks.
