法治视角下胡锦涛执政为民思想研究

【摘要】：党的十六大以来,以胡锦涛为核心的领导集体,对党在新世纪新阶段的执政为民问题进行了深入地思考、分析和研究,不仅提出了具有时代特征的执政为民思想,而且提出了如何利用法治来保障执政为民,形成了比较系统的执政为民思想,为加强和巩固党的执政建设作出了重要的贡献。本研究从法治和执政为民的基本内涵和关系出发,厘清了法治与胡锦涛执政为民思想之间的关系。通过介绍法治对胡锦涛执政为民思想形成的作用和该思想的形成过程,以及胡锦涛执政为民思想形成的理论渊源和特点,论述之所以法治对胡锦涛执政为民思想有重要的影响作用,主要在于党的十五大已经确立了依法治国、建设社会主义法治国家的治国方略,胡锦涛提出的执政为民思想必然是法治下的执政为民,并且执政为民也必须通过法治的方式来落实。作为执政党,如何解决依法执政为了谁、依法执政要靠谁以及依法执政谁监督等问题,是胡锦涛执政为民思想的主要追求,也构成了胡锦涛执政为民思想的科学内涵。胡锦涛执政为民思想是马克思主义中国化的重要成果,是科学发展观的重要组成部分,也是对毛泽东思想、邓小平理论和“三个代表”重要思想的坚持和发展,对以习近平为总书记的新一代领导集体继续实现执政为民有重要的理论和现实指导意义。在执政过程中,如何从法治角度与时俱进地巩固党的执政基础,如何坚持科学的权力观、法治观和利益观,如何坚持执政的科学性、有效性与人民性的统一,如何通过加强法治建设来保障人民群众的利益和权益,对不断地增强中国共产党执政的合法性基础、执政理念和执政能力的建设具有十分重要的启示。
[Abstract]:Since the 16th National Congress of the Party, the collective leadership with Hu Jintao as the core has deeply thought, analyzed and studied the issue of the party's governance for the people in the new century and new stage, and not only put forward the idea of governing for the people with the characteristics of the times, Moreover, it puts forward how to use the rule of law to protect the ruling for the people, forms a more systematic thought of governing for the people, and makes important contributions to strengthening and consolidating the ruling construction of the Party. Starting from the basic connotation and relationship between ruling by law and governing for the people, this study clarifies the relationship between the rule of law and Hu Jintao's thought of ruling for the people. By introducing the role of rule of law in the formation of Hu Jintao's thought of governing for the people and the forming process of this thought, as well as the theoretical origin and characteristics of the formation of Hu Jintao's thought of ruling for the people, The main reason why the rule of law has an important influence on Hu Jintao's thought of governing for the people lies in the fact that the 15th National Congress of the Party has established a strategy of governing the country according to law and building a socialist country ruled by law. Hu Jintao's idea of governing for the people is bound to be the ruling for the people under the rule of law, and the ruling for the people must also be implemented by the rule of law. As the ruling party, it is the main pursuit of Hu Jintao's thought of governing for the people and the scientific connotation of Hu Jintao's ruling for the people that how to solve the problems such as who to govern according to law and who should be in power according to law. Hu Jintao's thought of governing for the people is an important result of the Sinicization of Marxism, an important component of the scientific concept of development, and a continuation and development of Mao Zedong thought, Deng Xiaoping's theory and the important thought of "three represents." It has important theoretical and practical guiding significance for the new generation of leading collectives with Xi Jinping as general secretary to continue to realize governing for the people. In the process of governing, how to consolidate the ruling foundation of the Party from the angle of rule of law, how to adhere to the scientific view of power, the view of rule of law and the view of profit, how to insist on the scientific nature of governance, the unity of validity and people's character, How to protect the interests and rights of the masses by strengthening the construction of the rule of law is of great importance to the strengthening of the legitimacy foundation of the ruling of the Communist Party of China, the construction of the ruling concept and the construction of the governing ability.
