汉语法规英译的逻辑途径

随着我国改革开放力度的加大和对外贸易额的增加,我国法律翻译的研究工作显得十分迫切和重要。然而,我国近年来对法律翻译的研究工作远远落后于其它领域的翻译研究工作。法律翻译研究主要还停留在词、句的语言学层面,而对指导性更强的逻辑翻译学理论的研究还很不够。本文从法规文本的逻辑特点出发,以阎德胜的逻辑翻译学为理论基础,以Sarcevic对法律翻译特点的研究成果为依据,论证逻辑学在法规翻译中的指导作用,从而为法律翻译研究提供了新的视角,并为逻辑翻译学理论增加了佐证。文章由五部分构成。第一章揭示逻辑在翻译中的作用,并引出逻辑翻译学的概念。第二章揭示法规翻译与逻辑的特殊关系,提出法规翻译研究中应用逻辑的必要性。第三章从概念层上揭示逻辑的方法对法规翻译的指导作用。不同的法律体系含有不同的概念组成,因而给法规的翻译造成了概念对等上的难度。译者要能够分析概念的组成,并识别种属概念,并以种属概念为基础识别各类概念间关系,从而能够在目标文本中再现同一逻辑关系,以此减少翻译中的概念方面的错失。第四章从逻辑判断层次上讨论法规翻译的具体问题。法规条文内在的逻辑构成便是逻辑判断。译者应能识别法规条文内在的逻辑判断,并理...
