进城落户农民宅基地有偿退出的法律保障研究

【摘要】：土地是关切农民生存利益的根本性资源,其中宅基地则是根本中的根本,为农民修建遮风避雨的居所提供了条件。宅基地是具有社会保障功能和资产功能的特殊财产,对于农民来说至关重要。然而,随着我国经济的发展和城镇化进程的推进,一方面,农村劳动力向城市的流动使得农村大量宅基地闲置；另一方面,城镇化的发展又对有限的土地资源提出了新要求。因此,需要根据时下社会发展的新情况对土地资源的利用进行重新调整。结合当下的城镇化趋势,进城落户农民不断增多,而空出来的宅基地正好可以弥补城镇化用地的缺口,因此国务院在其规范性文件中确认了“宅基地有偿退出”这一双赢的模式。进城落户农民的宅基地有偿退出是一个新的土地资源流动模式,其中涉及到的诸多问题都值得探讨,本文从农民权益保障入手,对进城落户农民宅基地有偿退出的相关法律保障制度进行研究。除了引言和结语,本文分为以下四个部分：第一部分,进城落户农民宅基地有偿退出的理论与现实。通过先对我国宅基地制度演变历程的梳理得出现行宅基地制度改革的必要性,再将其与新型城镇化发展、户籍制度改革下进城落户农民土地财产权益实现的需要等现实问题相结合,论证解决“进城落户农民宅基地有偿退出”这一问题的现实意义。第二部分,进城落户农民宅基地有偿退出的现行规定与地方探索。由于国内关于宅基地退出的现行规定主要是数量庞杂的规范性文件,故无法对其全部整理。笔者主要从宅基地退出中申请主体、退出程序、退出补偿及退出的监管和救济制度几个方面为内容来整理了部分典型性规定。比较这些规定的异同,发现其存在的问题。然后,这部分还选取了国内宅基地有偿退出试点的三个典型地方——天津、重庆、浙江。从它们关于宅基地有偿退出的实践操作中总结经验,发现缺陷,为后文建立和完善宅基地退出的法律制度保障找到依据。第三部分,进城落户农民宅基地有偿退出的困境及困境的成因分析。这部分一方面是从前述现行规定及实践中总结出了宅基地退出申请主体标准不一致、退地程序趋行政化、退地补偿不合理、退地监管和救济乏力四大问题,另一方面则从宅基地退出系统保障理念不够、高位阶立法文件缺失及地区差异导致的具体困难三个方面对前面总结的问题进行了原因分析。第四部分,有序推进进城落户农民宅基地有偿退出的制度保障。这部分是针对前面第二、第三部分分析的宅基地有偿退出制度规范和实践的现状、存在的问题及问题成因而设计。主要从重塑退地过程中法律保障的基本理念、探索进城落户农民有偿退出宅基地规则的法律化、考虑宅基地有偿退出制度规范应规定的内容并作出宅基地有偿退出法律保障的具体规则设计这些方面来完成对进城落户农民宅基地有偿退出的法律保障。其中,具体规则设计包括了设定宅基地有偿退出的条件、丰富退地补偿内容、制定补偿标准、设定农民参与宅基地有偿退出的制度、建立和完善宅基地有偿退出的监管、救济及配套措施保障制度。
