资源型城市转型中民生权的法制化保障与实现路径

【摘要】：资源型城市的转型升级是世界城市化进程中的重要问题,民生权作为一项新兴的社会权利,随着资源型城市转型而日渐凸显。从欧美发达国家的资源型城市发展的历史脉络看,均采取法制化的路径解决民生权保障问题。改革开放以来,我国资源型城市的发展面临巨大挑战,社会保障存在历史遗留和社会新增问题,应运用法律手段,从宪法和社会保障法层面在制度上构建民生权保障体系,加快经济复苏步伐,实现我国资源型城市在经济新常态背景下的转型升级。
