【摘要】:2006年国际劳工组织出台了一部综合性海事劳工公约《2006年海事劳工公约》,涵盖了船员工作生活的各个方面,包括招募和安置、最低年龄、工作时间、安全、卫生和福利、劳动监察和社会保障等,为全世界船员设立了一套最低的工作和生活标准。2013年该公约已正式生效。《2006年海事劳工公约》正式生效对我国带来了迫切的压力。目前,我国的船员立法、管理以及船公司现实条件距离《2006年海事劳工公约》规定还有一定距离,公约规定的港口国强制监督制度将使我国处于不利的地位。因此,开展对我国船员整体权益保障的现状分析和对策研究显得非常有必要。文章主要运用了文献分析、走访调研、对比分析等方法,对《2006年海事劳工公约》产生的影响以及我国船员权益保障的现状进行了研究。首先,文章通过对国际公约和我国现有法律法规的学习研究,分析、梳理出船员这一特殊职业人群的权益、整体权益的内涵和外延。其次,文章将我国劳动保障相关法律与《2006年海事劳工公约》进行比较,找出立法方面存在的不足。再次,文章通过走访调研,分析出《2006年海事劳工公约》对船员以及我国船员权益保障现状的影响,以及船员群体权益保障的现状。最后,在借鉴航运发达国家船员权益保障立法和实践的基础上,为我国船员整体权益保障提出建设性的建议。文章提出的对策建议是建立在大量的比较分析和调研数据分析上的,更为全面和有针对性,可为我国船员权益保障事业提供实际可操作的参考,为切实推进我国船员整体权益保护工作提供支撑。
[Abstract]:In 2006, the International Labour Organization issued a comprehensive maritime labour convention, the Maritime Labour Convention of 2006, which covers all aspects of the working life of crew members, including recruitment and placement, minimum age, working hours, safety, health and welfare. Labor inspection and social security have set up a set of minimum working and living standards for crew members all over the world. In 2013, the Convention has entered into force. The entry into force of the Maritime Labour Convention of 2006 has brought urgent pressure to our country. At present, Our country's crew legislation, management and actual conditions of shipping companies are still far from the provisions of the Maritime Labour Convention of 2006. The mandatory port state supervision system stipulated in the Convention will put our country in a disadvantageous position. It is very necessary to carry out the present situation analysis and countermeasure research on the protection of the overall rights and interests of the crew of our country. This article mainly uses the methods of literature analysis, visiting investigation, comparative analysis and so on. This paper studies the influence of the Maritime Labor Convention of 2006 and the present situation of the protection of the rights and interests of the crew in our country. Firstly, the article analyzes the international conventions and the existing laws and regulations of our country through the study of the international conventions and the existing laws and regulations of our country. Combing out the rights and interests of the special professional group of crew, the connotation and extension of the whole rights and interests. Secondly, the article compares the relevant laws of labor security of our country with the Maritime Labour Convention of 2006, and finds out the shortcomings of the legislation. This paper analyzes the influence of the Maritime Labour Convention of 2006 on the present situation of the protection of the rights and interests of the crew members and crew members in China, and the present situation of the protection of the rights and interests of the crew groups. On the basis of drawing lessons from the legislation and practice of seafarers' rights and interests in developed countries, this paper puts forward constructive suggestions for the protection of the overall rights and interests of seafarers in our country. The countermeasures and suggestions in this paper are based on a large number of comparative analysis and investigation data analysis. It can provide practical and practical reference for the protection of crew rights and interests in China, and provide support for the overall protection of crew rights and interests in China.
