新型城镇化背景下农村土地流转问题研究

【摘要】：三农问题,核心是农民问题,农民是农村生产经营活动的主体;农民问题,重要问题之一就是土地问题,土地是农民最基本的生产资料。鉴于我国在城镇化进程中出现的各类资源、环境问题,提出新型城镇化发展战略,坚持大中小城市与小城镇相互协调发展,走具有中国特色的城镇化道路。就与农村人口和土地的关系而言,城镇化面临的两大重要问题是“人口如何集聚”和“土地如何利用”,农村土地流转在一定程度是是城镇化与工业化发展的产物,土地作为城镇化的载体,如何在坚持保护耕地的原则下,完善农地流转机制,满足新增的城镇建设用地需求,实现农村土地流转与城镇化建设相互协调,具有十分重要的理论与现实的意义。文章以国土资源部公开数据等资料作为主要参考数据来源,以马克思的产权配置市场化和土地资本化理论为指导;对新型城镇化、农村土地流转等主要概念进行了界定,明确本文所研究的农村土地流转形式包括农村土地承包经营权流转和农村土地所有权流转即农村土地征收两部分;对在新型城镇化和传统城镇化背景下农村土地流转的异同之处进行理论区分,并重点从实质理念、过程方法、具体路径、发展目的以及土地利用方式等方面分析了新型城镇化在农村土地流转层面对传统城镇化的超越;对新型城镇化与农村土地流转之间关系进行研究,并探讨了在新型城镇化背景下农村土地流转面临的机遇与挑战;对当前我国农村土地流转的基本状况进行两种类型的区别分析,并总结其不同的特点;对新型城镇化背景下农村土地流转存在的问题及原因分别从承包经营权和所有权流转即农村土地征收两个层面进行具体阐释;最后根据以上对在新型城镇化背景下农村土地流转所存在的问题与原因分析,本文从明确政府职能定位、发展中介组织、确定土地产权、完善土地流转市场以及推进社会保障制度建设等方面,探讨了建立符合新型城镇化发展目的的农村土地承包经营权流转秩序的可能性与现实性;从明确界定“公共利益”、农村土地产权制度改革、完善土地市场、改革征收程序、推进政治治理体制改革等方面,探讨了建立符合新型城镇化发展目的的农村土地所有权流转即农村土地征收秩序的相关对策建议。
[Abstract]:The core of the issue of agriculture, rural areas and farmers is the problem of farmers, who are the main body of rural production and management activities, and one of the most important problems of farmers is the question of land. Land is the most basic means of production for farmers. In view of the problems of resources and environment in the process of urbanization in China, a new urbanization development strategy is put forward, and the coordinated development of large, medium and small cities and towns is insisted. Take the road of urbanization with Chinese characteristics. As far as the relationship with rural population and land is concerned, The two important problems facing urbanization are "how to gather population" and "how to use land". To a certain extent, rural land circulation is the product of urbanization and industrialization, and land is the carrier of urbanization. Under the principle of protecting cultivated land, how to perfect the agricultural land transfer mechanism, meet the new demand of urban construction land, realize the coordination between rural land circulation and urbanization construction, It is of great theoretical and practical significance. This paper takes the data published by the Ministry of Land and Resources as the main reference data source, guided by Marx's theory of marketization of property rights allocation and land capitalization. The main concepts such as rural land circulation are defined and the forms of rural land transfer are defined. The forms of rural land transfer include rural land contractual management right transfer and rural land ownership transfer that is rural land expropriation. In the background of new urbanization and traditional urbanization, the differences and similarities of rural land circulation are theoretically distinguished, and the essential ideas, process methods, specific paths are emphasized. In the aspects of development purpose and land use mode, the paper analyzes the surpassing of the traditional urbanization in the rural land transfer level, and studies the relationship between the new urbanization and the rural land circulation. The paper also discusses the opportunities and challenges of rural land circulation under the background of new urbanization, analyzes the basic situation of rural land circulation in China, and summarizes its different characteristics. The problems and reasons of rural land circulation under the new urbanization background are explained from two aspects of contractual management right and ownership transfer namely rural land expropriation. Finally, according to the above analysis of the problems and causes of the rural land circulation under the new urbanization background, this article defines the government function, develops the intermediary organization, and determines the land property right. From the aspects of perfecting the land circulation market and promoting the construction of social security system, this paper discusses the possibility and reality of establishing the order of rural land contract management right circulation in line with the new urbanization development goal. From defining "public interest" clearly, reforming the system of rural land property right, perfecting the land market, reforming the procedure of expropriation, promoting the reform of political governance system, etc. This paper probes into the countermeasures and suggestions for establishing the rural land ownership transfer that is, the order of rural land expropriation, which is in line with the development of new urbanization.
