“银发同居”法律问题及对策研究

【摘要】：“银发同居”是“非婚同居”在老年人群体中的衍生物,故该现象隐含了一系列错综复杂的制度问题,随着我国社会老龄化的加快,“银发同居”越发普遍,相关法律纠纷也随之增多。由于我国法定婚姻制度和老年社会保障制度存在漏洞,许多老年人为躲避再婚风险和养老困境而被迫选择非婚同居,但同居后又因我国“银发同居”自身的不稳定性以及尚待完善的法律制度而不得不面对新的风险,最终陷入被动境地。面对即将到来的老龄高潮,为保护老年人权益,我们迫切需要对“银发同居”相关法律问题及对策进行研究,但我国学者的建议基本为“模仿法定婚姻制度建立银发同居制度”或“将‘银发同居’等同于‘事实婚姻’”,然而这些观点仅涉及单个维度,无法根本解决问题,反而有混淆概念之嫌。笔者认为,应对“银发同居”法律问题应从法定婚姻制度、老年社会保障制度和银发同居制度本身三方面着手,保证非婚同居能够成为老年人在完善的婚姻制度和银发同居法律制度相互平衡以及健全的老年社会保障的基础上主动做出的理性选择,而非为了躲避制度瑕疵而做出的权宜之计,从而更全面、彻底地消除制度弊端对老年人在结合方式选择上的消极影响,真正实现老年人的合理选择。笔者以相关理论、案例和调研结果为基础,通过实证分析方法、法经济学分析方法和比较研究方法分析导致“银发同居”产生的原因和“银发同居”自身引发的问题,并探索相应的对策。本文可为“银发同居”理论与实践提供多角度的新思路,更好地保障老年人权益,另外,对于整个“非婚同居”法律制度及其与“法定婚姻”的关系也可产生理论和实践上的贡献。
[Abstract]:"Silverhaired cohabitation" is a derivative of "non-marital cohabitation" among the elderly, so this phenomenon implies a series of complicated institutional problems. With the acceleration of the aging of our society, "Silverhaired cohabitation" is becoming more and more common. Due to the loopholes in the legal marriage system and the social security system for the elderly, many elderly people are forced to choose non-marital cohabitation in order to avoid the risk of remarriage and the dilemma of providing for the aged. But after cohabitation, we have to face new risks because of the instability of "cohabitation with silver hair" and the pending legal system, and finally fall into a passive situation. In the face of the coming climax of aging, in order to protect the rights and interests of the elderly, We urgently need to study the relevant legal problems and countermeasures of "cohabitation with silver hair". However, the suggestions of Chinese scholars are to "imitate the legal marriage system to establish the cohabitation system of silver hair" or "to equate 'silver hair cohabitation' with'de facto marriage'". However, these views only involve a single dimension and cannot solve the problem fundamentally. In my opinion, the legal problems of "cohabitation with silver hair" should be dealt with from three aspects: the legal marriage system, the social security system for the elderly and the cohabitation system itself. To ensure that non-marital cohabitation can become the rational choice of the elderly on the basis of perfect marriage system and silver cohabitation legal system and sound old age social security. It is not the expedient to avoid the defects of the system, so as to eliminate the negative influence of the system malpractice on the choice of the combination way of the elderly, and realize the rational choice of the elderly. Based on the case and investigation results, this paper analyzes the causes of "cohabitation with silver hair" and the problems caused by "cohabitation with silver hair" through the methods of empirical analysis, law and economics analysis and comparative research. This article can provide new ideas for the theory and practice of "cohabitation with silver hair", and better protect the rights and interests of the elderly. The whole legal system of non-marital cohabitation and its relationship with legal marriage can also make theoretical and practical contributions.
