土地流转背景下的农民社会保障问题研究

【摘要】：随着经济和城市化的发展,大量的土地流转了,一方面推动了我国经济发展;另一方面也产生了大量的土地流转农民。土地是农民的命根子,一旦被流转,农民生产和生活受影响,不得不从事其它职业。由于我国存在着城乡二元体制结构的影响,农民被排斥在社会保障体系这一公共产品之外,同时,又因为我国现行的土地流转制度不健全,导致了诸多土地流转农民“种田无地、社保无份、创业无钱”的境地,致使他们的生存权和发展权受到威胁,他们的社会保障问题已经成为社会的热点问题和棘手问题。文章首先写的是土地流转农民社会保障现状研究,五保保障对土地流转农民来说不在范围之列、家庭保障脆弱、生育保障有限和土地保障乏力。资金不足,资金来源要多元化,加强资金的管理和监督,防范基金风险。其次写土地流转农民社会保障问题表现,指出社会保障体系不健全,多头管理,水平低下,资金不足,城乡二元体制结构影响等不足。第三,具体分析了土地流转农民社会保障问题有七个残缺的原因。第四,通过对英国、美国和德国等西方国家社会保障制度的分析,笔者得出启示,认为建立社保政府要承担责任,重视社保立法,建立与我国经济社会发展水平相适应的土地流转农民的社会保障制度,资金来源多元化,共同承担风险,同时注重家庭保障。最后文章提出了土地流转农民社会保障应对之策,这是文章的重点。认为应该建立土地流转农民社会保障制度,在最低生活、养老、医疗、教育就业培训和法律援助等几个方面着手解决,最终目标是建立城乡一体化的社会保障制度。
[Abstract]:With the development of economy and urbanization, a lot of land has been transferred. On the one hand, it has promoted the economic development of our country; on the other hand, it has also produced a large number of farmers. Land is the lifeblood of farmers, once it is transferred, Farmers' production and livelihood are affected, and they have to engage in other occupations. Due to the influence of the urban-rural dual institutional structure, peasants are excluded from the social security system as a public good, and at the same time, And because the current land circulation system is not perfect in our country, it has led to the situation that many farmers have no land to farm, no social security and no money to start a business, which threatens their right to survival and development. Their social security problem has become a hot issue and a thorny problem in the society. The article first writes about the current situation of social security of farmers in land circulation. The five guarantees are not in the scope of farmers on land circulation. Family security is fragile, maternity security is limited, land security is weak, and funds are insufficient. We should diversify the sources of funds, strengthen the management and supervision of funds, and guard against fund risks. Secondly, we should write about the performance of the social security problems of farmers in land circulation, pointing out that the social security system is not perfect, that there are many kinds of management, that the level is low, and that the funds are insufficient. The influence of urban-rural dual system structure is insufficient. Thirdly, the paper concretely analyzes the seven incomplete reasons for the social security problem of peasants in land circulation. 4th, through the analysis of the social security system of the United Kingdom, the United States and Germany and other western countries, The author comes to the conclusion that the establishment of social security government should bear the responsibility, attach importance to social security legislation, establish a social security system for farmers in land circulation that is in line with the level of economic and social development of our country, diversify the sources of funds, and take risks together. At the same time, it pays attention to the family security. Finally, the article puts forward the countermeasures for the social security of the peasants in the land circulation, which is the focal point of the article. The final goal is to establish the social security system of urban and rural integration.
