城镇化进程中农村土地承包经营权流转法律问题探究

【摘要】：家庭承包责任制在过去的几十年里迅速激活生产力,表现出强大历史作用。但是随着城镇化进程的不断加快,工业的迅速崛起以及“三农”形势的发展变化,要求农业发展要不断现代化以适应当前发展。但当前分散式管理越来越阻碍了农业规模化发展的形成,捆绑了太多的人力,农业效率低,所以土地承包经营权的流转成为时代必然。我国与此相关的法律政策的出台,诸如《农村土地承包经营权流转管理办法》、《物权法》、《土地管理法》以及多年来的国务院中央一号文件都在促进农村土地流转,维护土地经营权人的正当利益方面起了积极推动作用。由于土地的特殊性,土地承包经营权流转的相关立法更多强调承包经营权的稳定性,缺少时代性的特征,某些方面的规范较笼统化。如农村集体土地权属问题,土地所有权主体方面以及对流转方式的某些限制和补充方面。此外我国相配套法律制度缺位也是城镇化进程中土地承包经营权的流转没有实现预期效果原因之一,如市场化流转机制不畅通,缺乏市场中间载体服务体制,农村社会保障制度力度不足以及与城镇化立法规划法律不协调等。本文从城镇化和农村土地承包经营权流转的含义、模式以及立法历程切入,解析当前农村土地经营权流转程序间出现的这些立法现象,借鉴国外流转给出相应的完善建议。这就要求城镇化推进中要想做好农村土地经营权流转工作必须发展城镇二三产业,创造更多的就业机会,同时提供培训机构,实现农民身份和生存方式的转变,这样才能实现了农业现代化和“以人为本”的城镇化。所有这一切都需要完备而针对性的法律法规来规范和指导,因此我们要逐步完善农村集体土地产权制度,完备经营权流转模式的立法规范,同时要完备经营权流转的系统保障机制,推动农村土地经营权流转的依法健康开展与普及,使土地经营权流转与城镇化进程相协调,使农村、农业和城镇共同发展进步,和谐有序,最终推动整个社会的健康与稳定。
[Abstract]:The household contract responsibility system has rapidly activated productivity in the past few decades, showing a strong historical role. However, with the continuous acceleration of urbanization, the rapid rise of industry and the development and change of the situation of "agriculture, rural areas and farmers", Agricultural development must be continuously modernized to adapt to the current development. However, the current decentralized management is increasingly hindering the formation of large-scale agricultural development, binding too many human resources, and agricultural efficiency is low. Therefore, the circulation of land contractual management right has become an inevitable trend of the times. For example, the "measures for the Management of the transfer of the right to contract Management of Rural Land", the "Law on property", the "Law on Land Management" and the document No. 1 of the Central Committee of the State Council over the years have all promoted the circulation of rural land. Because of the particularity of the land, the legislation related to the transfer of the land contractual management right emphasizes the stability of the contractual management right and lacks the characteristics of the times. Some aspects of the norm are more general, such as the issue of collective land tenure in rural areas, In addition, the absence of supporting legal system in China is one of the reasons why the transfer of land contractual management right has not realized the expected effect in the process of urbanization. For example, the market circulation mechanism is not smooth, the market intermediate carrier service system is lacking, the rural social security system is insufficient, and the urbanization legislation planning law is not in harmony. From the mode and legislative process, this paper analyzes these legislative phenomena among the current rural land management rights transfer procedures. This requires that in order to do a good job in the transfer of rural land management rights, we must develop the secondary and tertiary industries of cities and towns, create more employment opportunities, and at the same time provide training institutions. In order to realize the transformation of farmers' identity and way of life, the modernization of agriculture and the urbanization of "people-oriented" can be realized. All of these require complete and targeted laws and regulations to regulate and guide them. Therefore, we should gradually perfect the system of rural collective land property rights, perfect the legislative norms of the mode of circulation of management rights, and at the same time, perfect the system guarantee mechanism of the circulation of management rights, and promote the healthy development and popularization of the circulation of rural land management rights according to law. The circulation of land management right is coordinated with the process of urbanization, and the development and progress of countryside, agriculture and town are made together, harmony and order are achieved, and finally the health and stability of the whole society are promoted.
