实现中的权利:困境儿童社会保障政策研究

【摘要】：残疾儿童、家庭贫困儿童、家庭监护缺失及监护不当儿童构成困境儿童群体。当前,我国困境儿童的发展权在从法律权利向现实权利转变的过程中遇到了“保障性”障碍,儿童福利制度的不完善突显出来。与成人群体社会福利目标主要体现为生存权的保障不同,儿童社会福利救助是与其发展权积极相关的,对于儿童而言,发展权是建立在生存权基础之上的,由受教育权和参与权保障的基本权利。加强困境儿童社会保障工作,完善困境儿童的社会救助体系是当前实现困境儿童权益保护的现实路径。
[Abstract]:Children with disabilities, children with poor families, children with poor family custody and children with poor guardianship constitute the group of children in distress. At present, the right to development of children in distress in our country has encountered "indemnificatory" obstacles in the process of transition from legal rights to practical rights. The imperfection of the child welfare system is highlighted. Different from the social welfare goal of the adult group, the social welfare assistance for children is positively related to their right to development, and for children, the social welfare assistance is closely related to their right to development. The right to development is based on the right to survival and is guaranteed by the fundamental rights of the right to education and participation. Perfecting the social assistance system is the realistic way to realize the protection of children's rights and interests.
