城镇流动女性生育保险法律制度问题研究

【摘要】：随着我国经济的发展和男女平等思想的开放,大量的人口流入城镇,女性流动人员更是急剧增加。她们为城镇的繁荣发展做出巨大的贡献,是城镇现代化不可缺少的重要力量。然而她们在付出辛勤劳动的同时,社会保障权益由于政府重视不够,企业执行不力和流动女性维权意识薄弱等原因未能得到应有的保障。从保险标的来看,生育保险是一手托两命的重险,女性流动人口作为社会中的弱势群体,她们的生育状况值得全社会关注,妥善解决城镇流动女性的生育保险法律制度问题,无论是对生育妇女还是对国家社会都具有重大意义。本文首先从城镇流动女性及生育保险的概念及特征入手,引出本文论述的主题,进而介绍国内外生育保险法律制度现状;其次,对我国流动人口生育保险现状的相关数据进行分析,总结当前我国城镇流动女性生育保险法律制度存在的覆盖范围窄、参保率低和维权意识差等问题,然后从国家、政府、企业和个人四方面进行分析存在问题的原因；再次阐释了我国建立城镇流动女性生育保险法律制度的重要意义；最后通过借鉴国内外先进经验,提出切合我国实际的可行性建议,如制定包括城镇流动女性在内的生育保险条例,加大政府投入、加强基金管理、深化监督力度和强化企业的法律责任,同时加大宣传,提高流动女性的法律意识,维护自己的生育权益,为我国生育保险法律制度的改革打下基础。
[Abstract]:With the development of economy and the opening of the thought of equality between men and women, a large number of people flow into cities and towns, and the number of female migrants increases sharply.They make great contributions to the prosperity and development of cities and towns, and are an indispensable and important force in the modernization of cities and towns.However, while they work hard, the social security rights and interests have not been guaranteed due to insufficient attention from the government, weak implementation of enterprises and weak awareness of migrant women's rights and interests.From the point of view of the subject matter of the insurance, birth insurance is a heavy risk with two lives in the hands. As a vulnerable group in the society, the female floating population deserves the attention of the whole society, and the legal system of maternity insurance for migrant women in cities and towns should be properly solved.It is of great significance to women who bear children and to the society of the country.This paper begins with the concept and characteristics of urban floating women and maternity insurance, and then introduces the current situation of the legal system of birth insurance at home and abroad.This paper analyzes the relevant data of the current situation of floating population maternity insurance in China, summarizes the problems existing in the current legal system of floating women's maternity insurance in cities and towns in China, such as narrow coverage, low participation rate and poor awareness of protecting rights, and then from the state, the government,The reasons for the problems in four aspects of enterprises and individuals are analyzed; the significance of establishing the legal system of floating women's maternity insurance in cities and towns is explained again; finally, the advanced experience at home and abroad is used for reference.Put forward feasible suggestions in line with the reality of our country, such as formulating birth insurance regulations, including urban floating women, increasing government investment, strengthening fund management, deepening supervision and strengthening the legal responsibility of enterprises, and increasing publicity at the same time.To improve the legal consciousness of floating women, to safeguard their own reproductive rights and interests, to lay the foundation for the reform of the legal system of maternity insurance in China.
