【摘要】：社会权是为了解决资本主义高度发达下劳资对立与贫富悬殊等各种社会矛盾与弊害,防止传统的自由权保障流于空洞化,谋求全体国民特别是社会经济弱者的实质自由平等,而形成的新型人权。本文分析了国家在社会权保障方面的局限性和非政府组织在社会权保障方面的积极作用以及不同阶段的社会权保护模式后,提出了我国社会权保障措施:一方面,需要强化国家的责任,通过国家一系列积极行为为该目标的实现提供一个高效、便捷、安全的法制环境,建立起完善的社会权保障法律体系;另一方面,重视非政府组织在社会权保护方面所起到的积极作用,给予其必要的法律上的支持与帮助、政策上的鼓励与激励,同时加强其自身的优势,为更好的参与社会权保障创造条件。
[Abstract]:The purpose of social right is to solve all kinds of social contradictions and disadvantages, such as the contradiction between labor and capital and the disparity between the rich and the poor under the highly developed capitalism, to prevent the traditional right of freedom from flowing into the void, and to seek the substantive freedom and equality of all the people, especially the weak people of society and economy. And form a new type of human rights. After analyzing the limitations of the state in the social rights protection, the active role of the non-governmental organizations in the social rights protection and the different social rights protection models in different stages, this paper puts forward the social rights protection measures in China: on the one hand, It is necessary to strengthen the responsibility of the state, to provide an efficient, convenient and safe legal environment for the realization of this goal through a series of positive acts of the state, and to establish a sound legal system for the protection of social rights; on the other hand, We should pay attention to the positive role of non-governmental organizations in the protection of social rights, give them necessary legal support and help, encourage and encourage them in policy, and strengthen their own advantages to create conditions for better participation in the protection of social rights.
