吉林省农村土地流转制度改革问题研究

【摘要】：土地属于国家所有的最重要的自然资源,是农民赖以生存和发展的基础。合理利用农村土地,在资源优化配置的前提下实现农村土地的流转,不仅能够提高当前农村生产力,还能提高农民的收入。可见,农村土地问题关乎“三农”和经济社会发展的大局。当前,吉林省农村土地流转规模和速度呈现积极良好的发展态势,对吉林省经济社会的快速发展起到一定的推动作用。但也应该客观的看到,吉林省农村土地流转制度在很大程度上仍然存在不足,制约了农村土地流转的健康发展。因此,研究并解决好农村土地流转制度对促进吉林省“三农”问题和第一产业的健康发展意义重大。论文第一部分对农村土地流转制度的相关概念和基本理论进行了梳理。第二部分对吉林省农村土地概况及土地流转的基本情况进行了论述,并总结了吉林省农村土地流转的主要形式和吉林省农村土地流转存在的主要问题:农村土地流转的程序操作不规范;农村土地流转的期限较短;农村土地流转后的社会保障措施不完善等。针对论文第二部分提出的问题,论文主要从经济因素、社会因素和观念因素等方面进行了理性分析。论文第四部分对完善吉林省农村土地流转制度,创新解决农村土地的流转问题给出了几点对策:首先应该明确并重构农村土地产权制度的设想。一是完善土地承包经营权流转制度;二是完善集体建设用地使用权流转制度;三是完善宅基地使用权流转制度。其次,健全并完善农村土地流转制度的长效机制。包括进一步创造农村劳动力转移的条件、规范政府行为、进一步完善土地流转市场的价格形成机制、建立完全中介机构。最后,改善失地农民的社会保障制度。
[Abstract]:Land belongs to the most important natural resources owned by the country and is the basis for farmers' survival and development. The rational use of rural land and the realization of the circulation of rural land under the premise of optimal allocation of resources can not only improve the current rural productivity but also increase the income of farmers. Visible, rural land issues related to the "three rural" and the overall situation of economic and social development. At present, the scale and speed of rural land circulation in Jilin Province show a positive and good development trend, and play a certain role in promoting the rapid economic and social development of Jilin Province. However, it should be seen objectively that the rural land circulation system of Jilin Province is still insufficient to a large extent, which restricts the healthy development of rural land circulation. Therefore, it is of great significance to study and solve the rural land transfer system to promote the "three rural" problems and the healthy development of the primary industry in Jilin Province. The first part of the paper on the rural land transfer system related concepts and basic theories were combed. The second part discusses the general situation of rural land and the basic situation of land circulation in Jilin Province. The paper also summarizes the main forms of rural land circulation in Jilin Province and the main problems existing in the rural land circulation in Jilin province: the procedural operation of rural land circulation is not standardized, the period of rural land circulation is short; Rural land circulation after the social security measures are not perfect. In view of the problems raised in the second part of the paper, the paper mainly analyzes the economic factors, social factors and conceptual factors. The fourth part of the paper gives some countermeasures to perfect the system of rural land circulation in Jilin province and to solve the problem of rural land circulation innovatively: firstly, we should make clear and reconstruct the assumption of rural land property right system. The first is to perfect the circulation system of land contractual management right; the second is to perfect the circulation system of collective construction land use right; the third is to perfect the circulation system of homestead right to use. Secondly, perfect and perfect the long-term mechanism of rural land circulation system. It includes further creating conditions for rural labor force transfer, standardizing government behavior, further perfecting the price formation mechanism of the land transfer market, and establishing complete intermediary organizations. Finally, improve the land-lost farmers social security system.
