中国技术移民法律制度研究

【摘要】:自上世纪80年代以来各国为了吸引国际人才纷纷制定和完善了其技术移民法,以增强国家的竞争力,由于我国在此方面起步较晚,与发达国家等存在较大的差距。我国吸引外国人才最重要的部门规章为2004年8月发布并实施的《外国人在中国永久居留审批管理办法》,其发布标志着我国的技术移民制度的确立。该办法实施后,在对于高级人才的吸引方面有着积极的作用,但其在面对经济快速发展的同时,该办法中存在的诸如对于技术移民的资格标准划分过于单一与刻板、法律条文不详细等问题也凸显出来,造成了引进外国人才的成本与数量与预期大不相符,因此有必要对我国的技术移民法律制度问题进行研究。首先,笔者在文章的第一、二部分对技术移民法律制度的基本理论及建立与完善中国技术移民法律制度的缘由、意义进行了论述,阐述了建立与完善中国技术移民法律制度的必要性及紧迫性。其次,笔者按技术移民法律制度按流程顺序分为审核评估制度及移民融合制度两大类,在文章的第三部分对现今世界所采取建立的有关技术移民审核评估及移民融合制度进行了列举,并一一分析各制度与措施的功能与目的。最后,在第四部分先对中国的技术移民法律制度的发展历史进行了梳理,并将现行有效的技术移民法律制度的渊源列举梳理出,而后以现行的中国技术移民法律制度与世界主流的技术移民法律制度进行比较,分析得出我国现行的技术移民法律制度在形式、审核评估以及移民融合制度中存在的弊端。其后于文章的第五部分对第四部分分析出的问题结合他国技术移民的经验提出一些完善的建议,即形式上建立统一的技术移民法。在审核评估制度上将外国人才引进的审批管理权限集中至单一部门,并调整人才的定义范围,建立起客观的积分评估制度及本国公民的工作权保护制度。移民融合方面在建立一套适用我国国情的移民融合制度上侧重于外国人才的经济、社会保障及生活环境的完善,使其更愿意留在我国居住与工作。
[Abstract]:Since the 1980s, in order to attract international talents, countries have formulated and perfected their laws on technology migration in order to enhance the competitiveness of the country. Due to the late start of our country in this respect, there is a big gap with the developed countries. The most important department regulation for attracting foreign talents in China is the measures for the examination and approval of foreigners' permanent residence in China issued and implemented in August 2004, which marks the establishment of China's skilled migration system. After its implementation, it has a positive role in attracting high-level talent, but in the face of rapid economic development, such as the eligibility criteria for skilled migrants, the distinction between eligibility criteria in the scheme is too single and rigid, The legal provisions are not detailed and so on, which makes the cost and quantity of introducing foreign talents far from expected. Therefore, it is necessary to study the legal system of skilled migration in China. First of all, in the first and second parts of the article, the author discusses the basic theory of the legal system of skilled migration and the reason and significance of establishing and perfecting the legal system of skilled migration in China. This paper expounds the necessity and urgency of establishing and perfecting the legal system of skilled migration in China. Secondly, according to the legal system of skilled migration, the author divides it into two categories according to the sequence of process: audit and evaluation system and immigration integration system. In the third part of the article, the author enumerates the relevant technology migration audit and evaluation system and immigration integration system adopted in the world, and analyzes the function and purpose of each system and measure one by one. Finally, in the fourth part, the history of the development of China's legal system of skilled migration is combed out, and the sources of the current effective legal system of skilled migration are listed out. Then by comparing the current legal system of Chinese skilled migration with the mainstream legal system of skilled migration in the world, the author analyzes the disadvantages of the current legal system of skilled migration in the form, examination and evaluation, as well as in the system of immigration integration. Then, in the fifth part of the article, the author puts forward some perfect suggestions on the problems analyzed in the fourth part combined with the experience of other countries' skilled migration, that is, to establish a unified law of skilled migration in form. In the system of audit and evaluation, the authority of examination and approval of foreign talents is centralized into a single department, and the definition of talents is adjusted to establish an objective system of integral evaluation and the system of protecting the work rights of citizens. In the aspect of immigration integration, the establishment of a set of immigration integration system suitable for China's national conditions focuses on the improvement of foreign talents' economy, social security and living environment, which makes them more willing to live and work in our country.
