城市化进程中失地农民权益法律保护研究

【摘要】：城市化是社会经济发展的趋势,近些年来,随着我国城市化进程的加快,原有的城市土地已不能满足城市化对土地的大量需求,城市向农村借地成为必然趋势,由此形成庞大的失地农民群体。当前,由于我国法律规定以及制度上的一些缺陷,失地农民在社会经济生活中的权益并未得到相应的保护,导致各种冲突和群体性事件不断,最终制约城市化进程及社会和谐。城市化是社会发展不可逆转的趋势,但最大限度的保护在城市化进程中牺牲自己权益的失地农民却是应当和必须的。本文分五个部分对城市化进程中失地农民权益的保护进行了研究。第一部分导论主要撰写了本文的选题背景和研究意义、研究综述以及本文的研究方法。第二部分主要对文章涉及的概念作出了界定,分析了城市化与失地农民权益的关系。第三部分析了城市化进程中失地农民权益缺失的表现,主要分两大部分,从物质方面的权益和精神方面的权益进行探究。第四部分针对失地农民权益缺失的现状,从土地制度、征地制度、征地补偿制度以及城乡二元结构几个方面研究了失地农民权益缺失的原因。第五部分主要从完善农村土地产权法律制度、征地法律制度、征地补偿法律制度以及社会保障法律制度几个方面提出建议,进而更好的保障失地农民的权益。
[Abstract]:Urbanization is the trend of social and economic development. In recent years, with the acceleration of urbanization in China, the original urban land can no longer meet the large demand of urbanization for land, so it is an inevitable trend for cities to borrow land from rural areas. As a result, the formation of a large group of landless farmers. At present, due to some defects in laws and regulations of our country, the rights and interests of landless peasants in social and economic life have not been protected accordingly, resulting in various conflicts and group events, which ultimately restrict the process of urbanization and social harmony. Urbanization is an irreversible trend of social development, but it is necessary and necessary to protect the land-losing peasants who sacrifice their rights and interests in the process of urbanization. This paper is divided into five parts to study the protection of the rights and interests of landless farmers in the process of urbanization. The first part mainly introduces the background and significance of this paper, the research review and the research methods of this paper. The second part mainly defines the concept involved in the article and analyzes the relationship between urbanization and the rights and interests of landless farmers. The third part analyzes the lack of rights and interests of land-lost farmers in the process of urbanization, mainly divided into two parts, from the material and spiritual aspects of the rights and interests to explore. In the fourth part, according to the current situation of the lack of land farmers' rights and interests, the paper studies the reasons of the loss of land farmers' rights and interests from the land system, the compensation system of land expropriation and the dual structure of urban and rural areas. The fifth part mainly puts forward some suggestions from the aspects of perfecting the legal system of rural land property right, land expropriation and compensation, and social security legal system, so as to better protect the rights and interests of landless farmers.
