平等权视野下的社会保障制度研究

【摘要】：对于社会保障制度从社会学、经济学、公共管理学等领域展开研究已经具有显见的成效，而从法学领域研究社会保障问题，在我国的历史并不长，其中从宪法意义上平等权的视角审视这一问题，在法学界则关注不多但却极有必要。平等权与社会保障制度具有密切的理论关联，平等权是社会保障制度形成的理论和基础，，社会保障制度则是平等权的实现途径。而作为社会保障制度中的各个分支部分，即社会保险、社会福利、社会救济、社会优抚等，既是基于追求实质平等观这一前提而建立的诸具体制度，同时，通过各单行立法而建立起的各项制度又体现出对公民实质意义上平等权的保障作用。我国的社会保障制度起步较晚，在实施中也存在着诸多问题，也直接影响到公民平等权的实现，只有通过完善相关立法、理顺行政体系、细化司法救济程序等，才能真正实现社会保障制度与公民平等权之间的互动作用。
[Abstract]:The research on social security system from the fields of sociology, economics, public management and so on has already had remarkable results, but the history of studying social security from the legal field is not long in our country. To examine this issue from the perspective of constitutional equality, it is necessary to pay less attention to it in the field of law. The right to equality is closely related to the social security system, the right to equality is the theory and foundation of the formation of the social security system, and the social security system is the way to realize the right to equality. As a branch of the social security system, such as social insurance, social welfare, social relief, social benefit, etc., it is not only based on the pursuit of the concept of substantive equality of the establishment of the specific system, at the same time, The system established through the separate legislation also embodies the protection of citizens' right to equality in essence. The social security system of our country starts relatively late, also has many problems in the implementation, also directly affects the realization of the citizen equality right, only through perfecting the relevant legislation, straightening out the administrative system, refining the judicial relief procedure, etc. Only then can the interaction between the social security system and the equal rights of citizens be realized.
