我国工伤保险基金先行支付制度研究

【摘要】：2010年10月28 日,《中华人民共和国社会保险法》首次确立了工伤保险基金先行支付制度。该制度一经制定就受到了理论界和实务界的普遍关注,因其充分体现了以人为本的价值理念,向处于弱势群体的劳动者倾斜保护,旨在使工伤职工得到及时的医疗和救治,从而进一步促进社会的和谐与稳定。但由于我国初次立法确定该制度,制度本身还不够成熟,导致其实施效果大打折扣,没有发挥出制度应有的价值和功能,与立法本意相距甚远。因此,本文将对该制度进行研究,以期能够为制度的完善尽一份力。论文分为四个部分,第一部分对我国的工伤保险基金先行支付法律制度进行阐述,包括该制度的内涵、法理基础以及功能;第二部分是该制度的实施现状进行分析,并探索该制度存在的问题;第三部分针对性的介绍域外相关的经验,为完善我国工伤保险基金先行支付制度作参考;第四部分是借鉴域外先进经验的基础上,结合我国实际情况提出完善建议。
[Abstract]:On October 28, 2010, the Social Insurance Law of the people's Republic of China established the advance payment system of industrial injury insurance fund for the first time. Once the system is formulated, it has received widespread attention from the theoretical and practical circles. Because it fully embodies the people-oriented value concept and tilts protection to the workers in the vulnerable groups, it is aimed at making the injured workers get timely medical treatment and treatment. So as to further promote social harmony and stability. However, the system itself is not mature enough because of the initial legislation of our country, which results in its implementation effect being greatly reduced, and the value and function of the system are not brought into play, which is far from the original intention of the legislation. Therefore, this paper will study the system in order to contribute to the improvement of the system. The thesis is divided into four parts. The first part expounds the legal system of advance payment of industrial injury insurance fund in our country, including the connotation, legal basis and function of the system; the second part is the analysis of the current situation of the implementation of the system. And explore the problems of the system; the third part of the targeted introduction of extraterritorial experience, for the improvement of China's industrial injury insurance fund advance payment system for reference; the fourth part is to learn from the foreign advanced experience on the basis, According to the actual situation of our country, some suggestions are put forward.
