“过劳死”法律规制研究

【摘要】：劳动者的权益保障是劳动力市场健康和谐发展必不可少的一道防线,但由于我国劳动者权益保障的法律规制起步晚、发展慢,远远滞后于我国社会经济发展的步伐,使得这一防线常常陷入不攻自破的尴尬境地,而我国劳动者“过劳死”问题的法律规制更是处于这一防线的外围。在“法治时代”的大背景下,对于“过劳死”的法律规制研究,不仅可以增强过劳死研究的理论依据,同时在实务操作中,对于过劳死的预防与救济也具有很大的现实意义。本文对我国“过劳死”法律规制问题的研究分四个部分进行论述：第一部分“过劳死的理论分析”,通过简要阐述过劳死的概念、特征及法律性质,使我们对于过劳死有个基本的理论认识,同时认清目前我国过劳死理论研究的现状,即没有统一的过劳死概念认定,没有统一的法律性质界定,我国过劳死问题研究的“本土化”还处于起步阶段。第二部分我国“过劳死问题的现状及规制中的法律不足”,通过对近几年来我国疑似“过劳死”事件的列举、我国职场过劳现象调查数据的佐证,以及法律对于过劳死规制的苍白窘况,验证了我国过劳死问题的现状与我国过劳死法律规制的滞后有着密切的关系。第三部分“域外相关制度的经验借鉴”,笔者简要阐述了日本对于“过劳死”的认定标准与防治机制,以及美国在防治“过劳死”问题上的法制价值取向,为我国过劳死的认定、防治提供了宝贵的经验借鉴。第四部分“完善我国过劳死法律规制的建议”,通过前三章理论、事务及经验的阐释,进一步分析如何完善我国过劳死法律治理对策,即立法治其本,通过完善现有立法并将过劳死纳入工伤认定使其救济有法律的明文保障；加强相关社会保障等配套机制的完善,使过劳死预防有可行的制度约束。
[Abstract]:The protection of workers' rights and interests is an indispensable line of defense for the healthy and harmonious development of the labor market. However, due to the late start and slow development of the legal regulation of the protection of workers' rights and interests in our country, it lags far behind the pace of social and economic development in our country. This line of defense is often trapped in an awkward situation, and the legal regulation of the problem of "overworked death" of Chinese workers is in the periphery of this line of defense. Under the background of "the era of rule of law", the study of legal regulation of "overwork death" can not only strengthen the theoretical basis of the study of overwork death, but also have great practical significance in practical operation, for the prevention and relief of overwork death. This paper discusses the legal regulation of "overwork death" in China in four parts: the first part, "theoretical analysis of overwork death", through a brief description of the concept, characteristics and legal nature of overwork death. So that we have a basic theoretical understanding of the death of overwork, and at the same time recognize the current situation of the theoretical research on the death of overwork in our country, that is, there is no unified definition of the concept of overwork death, no unified definition of the legal nature, The localization of the study of overwork death in China is still in its infancy. The second part of our country "the current situation of overwork death problem and the law insufficiency in regulation", through the enumeration of our country suspected "overwork death" event in recent years, our country workplace overwork phenomenon investigation data proof, And the paucity of the legal regulation of the death of overwork proves that the current situation of the problem of overwork is closely related to the lag of the legal regulation of the death of overwork in our country. In the third part, "the experience of overseas related system", the author briefly expounds the Japanese standard of "overwork death" and its prevention mechanism, as well as the legal value orientation of the United States in the prevention and cure of "overworked death". It provides valuable experience for the identification and prevention of overwork death in China. The fourth part "the suggestion of perfecting the legal regulation of overworked death in our country", through the explanation of the theory, affairs and experience of the first three chapters, further analyze how to perfect the legal management countermeasure of the death of overwork in our country, that is, the legislation governs its root. By perfecting the existing legislation and bringing overwork death into the identification of work-related injury so that its relief has the explicit protection of the law; strengthen the relevant social security and other supporting mechanisms to improve the prevention of overwork death has a feasible system constraints.
