和谐社会视阈中的失地农民的权益保障问题研究

【摘要】：随着中国经济突飞猛进的发展,推动城市化进程,实现城市经济一体化,农民陆续地主动或被动与土地分离开来,失去土地的农民在中国社会越来越壮大形成一个群体——失地农民。这个在社会群体中越来越成为不容忽视的群体,也形成了一些当今时代所特殊具有的社会矛盾,在一定程度上影响了城市化进程的推进和社会和谐的构建,所以他们在失去土地后的权益保障状况受到了多个领域的关注,而且因失地农民而引起的社会问题和社会矛盾有口益激化的趋势,对于以和谐社会的发展理念的中国来说,是急需解决的重大问题,以保障中国在构建社会主义和谐社会的发展道路中稳步前进。本文以海南省为例,对海南省失地农民的权益保障问题从各方面进行研究,切实提出解决失地农民权益保障问题的有效对策。本文先了解了海南省征收土地的数量状况、失地农民的数量状况、失地农民的话语权受损现状、失地农民的补偿权受损现状、失地农民的发展权受损现状来从产生的危害中发现地方政府、失地农民、开发商三个博弈方的地位优劣,大到法律法规小到失地农民自身似乎天平永远没有倾向失地农民,失地农民如何从完全被动和劣势的状态绝处逢生是十分艰巨并且迫不及待的问题。通过对海南省的与失地农民相关问题中,本文从征地制度方面、补偿制度方而、上地所有权问题、土地与失地农民完全切割关系、行政监督机制等方面去分析失地农民权益受损的根本。从而认清海南省失地农民权益保障问题症结所在,提出了从失地农民的话语权、补偿权、开发权三方面的如何有效保障以及建立一个监督的大环境的解决方案,以保证从根本上解决失地农民权益受损的问题,减少关于失地农民社会问题的发生,防止失地农民的社会问题上升为政治问题,促进城市化进程的推进,以保证和谐社会的构建。
[Abstract]:With the rapid development of China's economy, the process of urbanization and the integration of urban economy, farmers have gradually separated from the land actively or passively. The farmers who have lost their land have grown more and more in the Chinese society and formed a group of landless peasants. This is becoming a group that can not be ignored in the social group. It has become a special social contradiction in today's times, which has influenced the advancement of the urbanization process and the construction of social harmony to a certain extent. Therefore, the protection of their rights and interests after the loss of land has been paid attention to in many fields, and the social and social contradictions caused by the landless peasants have a trend of intensification. For the development concept of a harmonious society, China is a major problem to be solved urgently in order to ensure the steady progress of China in the development of a socialist harmonious society. This article takes Hainan Province as an example to study the protection of the rights and interests of the landless peasants in Hainan province from all aspects, and put forward a practical solution to the protection of the rights and interests of the landless peasants.
