山东省金乡县农村土地流转问题研究

【摘要】：农村土地流转是备受社会关注的热点问题,也是近几年中央涉农文件中频繁出现的关键词。在举国推进新型城镇化的浪潮中,现代农业如何发展,美丽乡村如何建设,城镇用地如何保障,这些都难以绕开土地流转问题,进而考验着各级政府的智慧。适逢国家在大力推进农村综合改革,国土资源部也同时开展土地制度改革试点之机,开展农村土地流转研究具有理论和实践双重意义。本文综合运用了文献研究法、经验总结法、问卷调查法等多种手段,在参考国内外相关文献的基础上,结合当前我国土地流转实践,重点剖析了山东省金乡县土地流转案例,概括了该县农村土地流转中存在的突出问题,并就其成因进行了深入探讨。同时立足山东,放眼全国,借鉴国内其它省市先进经验和做法,结合本人的深刻思考,提出了关于加快土地流转的系列对策建议,对国内其它农业县土地流转也提供某些参考。第一章为绪论篇。结合国家政策形势,阐述了研究背景、研究目的和研究意义,并对当前该领域国内外研究进展情况进行了综述,阐明了研究思路、研究方法、创新点及不足等。第二章为理论篇。阐述了土地流转的有关概念、理论、政策和法律法规,概括了我国土地流转制度发展演变的三个历程,创造性地提出了土地流转类型划分新标准,并据此将之分为农业用地承包经营权流转、集体建设用地使用权流转和集体建设用地发展权三大类型。第三章为实践篇。通过问卷和访谈等形式,调查了山东省金乡县的土地流转情况,分析了当前土地流转普遍存在的共性问题及原因,系统总结了行之有效的经验和做法。第四章为对策篇。针对上述问题提出了六条对策建议,即加快土地确权、创新流转方式、完善服务体系、强化政策引导、加强社会保障、健全法律法规。希望本文能为各地土地流转工作提供借鉴和参考,以此促进我国农村土地流转高效推进,农业规模化经营健康发展,农民财产性收益持续增加。
[Abstract]:Rural land circulation is a hot issue of social concern, and it is also the key word frequently appeared in the central agricultural documents in recent years. In the tide of promoting new urbanization in the whole country, how to develop modern agriculture, how to build beautiful countryside and how to guarantee urban land are difficult to circumvent the problem of land circulation, and then test the wisdom of governments at all levels. At the same time, the Ministry of Land and Resources also has the opportunity to carry out the pilot project of land system reform. It is of both theoretical and practical significance to carry out the research on rural land circulation. This article synthetically uses the literature research method, the experience summary method, the questionnaire survey method and so on, in the reference domestic and foreign related literature foundation, unifies the present our country land circulation practice, has analyzed the Shandong Province Jinxiang county land circulation case emphatically, This paper summarizes the outstanding problems existing in the rural land circulation in this county, and probes into the causes. At the same time, based on Shandong, looking at the whole country, drawing lessons from the advanced experiences and practices of other provinces and cities in China, combining with my profound thinking, this paper puts forward a series of countermeasures and suggestions on speeding up the land circulation, which provides some references for the land circulation of other agricultural counties in China. The first chapter is the introduction. Combined with the situation of national policy, this paper expounds the background, purpose and significance of the research, and summarizes the research progress in this field at home and abroad, and clarifies the research ideas, research methods, innovation points and shortcomings, etc. The second chapter is the theory. This paper expounds the related concepts, theories, policies and laws and regulations of land circulation, summarizes the three processes of the development and evolution of the land circulation system in China, and creatively puts forward new standards for the classification of land circulation types. According to this, it can be divided into three types: the right to contract management of agricultural land, the right to use collective construction land and the right to development of collective construction land. The third chapter is the practice chapter. By means of questionnaire and interview, this paper investigates the situation of land circulation in Jinxiang County, Shandong Province, analyzes the common problems and causes of current land circulation, and systematically summarizes the effective experience and practice. The fourth chapter is the countermeasures. In view of the above problems, this paper puts forward six countermeasures and suggestions, that is, speeding up the confirmation of land rights, innovating the circulation mode, perfecting the service system, strengthening policy guidance, strengthening social security, and perfecting laws and regulations. I hope this paper can provide reference and reference for the work of land circulation in various places, so as to promote the efficient promotion of rural land circulation in China, the healthy development of large-scale agricultural management, and the continuous increase of property income of farmers.
