青少年罪错行为分析与矫治对策探究

【摘要】：目前,我国青少年罪错问题是一个严重的社会问题,对青少年罪错行为的矫治,不论是学术界还是实践领域都付出了巨大的努力。厘清“青少年罪错”的概念,有助于正确认识青少年罪错与其他犯罪的本质区别,有利于开展青少年问题的解决与矫治,体现着现代法治理念。西方国家从19世纪开始就对青少年罪错行为的矫治进行了持续的探索,这其中对我国青少年罪错行为矫治有许多启示之处。在我国,青少年罪错行为矫治也在建国后历经了探索、初创、起步、调整、深化五个主要阶段。但是,我国青少年罪错行为矫治在法制教育、思想品德教育、文化知识、职业技能教育、心理咨询、疏导与矫治、实践活动中的改造、学术研究等方面依然一些亟待解决的的问题。当前,随着我国社会的转型,我国青少年罪错行为呈现出盲目性与模仿性、低龄化与多样性、犯罪化与严峻性、可控性和预防性的新特点。导致青少年罪错行为的原因有内因和外因两个方面：在内因方面主要是青少年生理上的不成熟、心理上的不稳定、知识上的不完善和行为因素；外因主要是社会环境的影响与熏染、家庭功能的弱化与缺失、学校教育的偏差与漏洞。青少年罪错行为对自身、对家庭、对社会都具有一定的危害性。对青少年罪错行为的矫治有系统的理论依据和充分的现实依据,哲学、心理学、教育学、法学、社会学共同构成了青少年罪错行为矫治的理论依据。同时在现实依据方面,青少年自身的特点为矫治提供了可能性,已有矫治成果见证了矫治的有效性,我国的基本社会制度为矫治提供了可行性。对青少年罪错行为进行矫治要依据心理矫治和行为矫治、强制矫治与自觉调整、个别矫治与集体矫治、“惩教结合、以教为主”、系统性和科学性相结合的基本原则。探索青少年罪错行为矫治的对策与路径,要构建多元化青少年罪错行为矫治体系,加强青少年罪错行为矫治的立法与司法工作,充分发挥社区在矫治中的功能和作用,针对青少年不同罪错行为分类采取针对性矫治措施目前,吉林省针对青少年罪错行为呈现出的新特点,对青少年罪错行为矫治的进行了积极的探索,形成了一些有效的做法与经验。吉林省今后将深入推进“为了明天——预防青少年违法犯罪工程”,积极探索预防青少年违法犯罪工作的规律,进一步加强和完善青少年罪错行为的矫治与预防工作。
[Abstract]:At present, the problem of juvenile delinquency in China is a serious social problem. The correction of juvenile delinquency has made great efforts in both academic and practical fields. It is helpful to correctly understand the essential difference between juvenile delinquency and other crimes, to solve and correct juvenile problems, and to embody the concept of modern rule of law. Since 19th century, the western countries have continued to explore the correction of juvenile delinquency, among which there are many enlightenments for the correction of juvenile delinquency in China. After the founding of the people's Republic of China, the correction of juvenile delinquency has also undergone five main stages, starting, starting, adjusting and deepening. However, the correction of juvenile delinquency in China is in legal education, ideological and moral education, cultural knowledge. There are still some problems to be solved in vocational skill education, psychological counseling, counseling and correction, reform in practical activities, academic research, and so on. At present, with the transformation of our society, juvenile delinquency in China presents blindness and imitation, younger age and diversity, crime and severity. The new characteristics of controllability and prevention. The causes of juvenile delinquency are internal cause and external cause: the internal cause is mainly physiological immature and psychological instability. Imperfect knowledge and behavioral factors; The external causes are mainly the influence and influence of social environment, the weakening and lack of family function, the deviation and loophole of school education. To some extent, it is harmful to the society. There is a systematic theoretical basis and sufficient practical basis for the correction of juvenile delinquency, philosophy, psychology, pedagogy, law. Sociology together constitutes the theoretical basis for the correction of juvenile delinquency. At the same time, the characteristics of adolescents themselves provide the possibility of correction, and the results of correction have witnessed the effectiveness of correction. The basic social system of our country provides the feasibility for correction. The correction of juvenile crime and wrong behavior should be based on psychological correction and behavior correction, compulsory correction and conscious adjustment, individual correction and collective correction, "Correctional combination." The basic principle of combining systematicness and scientificalness is to explore the countermeasures and paths of correction of juvenile delinquency, and to construct a pluralistic system of correction of juvenile delinquency. Strengthen the legislation and judicial work of juvenile crime and wrong behavior correction, give full play to the function and role of community in correction, and take targeted corrective measures against different categories of juvenile crime and wrong behavior At present, in view of the new characteristics of juvenile delinquency, Jilin Province has made a positive exploration on the correction of juvenile delinquency. Some effective practices and experiences have been formed. In the future, Jilin Province will further promote the "Project for the Prevention of Juvenile delinquency for the sake of tomorrow," and actively explore the law of prevention of juvenile delinquency. We should further strengthen and improve the correction and prevention of juvenile delinquency.
