【摘要】：本文是研究12-16世纪英国农民土地权利的一篇文章。中世纪至近代早期英国农民的土地权利演变的过程,可以说是农民对土地占有强度的不断加深,产权逐渐明晰化的一个过程,并最终实现了对土地的个人财产权。全文分为三部分：第一部分为绪论,主要阐述论文选题的来源,总结国内外学者对该选题的研究状况,并阐明本文要研究的问题与研究方法。第二部分是论文的主体部分,一共三章,其中第一章论述出租制形式在盎格鲁-撒克逊时期的英国就已经出现了,由于黑死病和土地市场的影响和领主的自营地大量出租,租赁持有者的人数得到了大量增加,同时,随着自由持有地、惯例持有地和公簿持有地向租赁持有地的转变以及自由持有地和惯例持有地的转租,到了1600年,自营地、自由持有地和惯例持有地都已大量出租,租赁持有者已经具有一定的规模。第二章论述了英国租赁持有者的人数和种类,并从经济和法律的角度考察了12-16世纪间,租赁持有者对土地的占有强度在不断地加深。第三章论述租赁持有者的出现及其发展,对英格兰的经济社会产生了很大的影响,它改变了英格兰乡村的经营模式,农民需要作出许多改变来适应这些新变化；非农民承租者更容易获得技术上的革新；有着商业背景的承租者通过农产品的贸易而带来了资本主义式的生产方式。租赁持有者的出现是租地农场主出现的重要原因,13、14世纪的租地农场主就是当时的租赁持有者,到16世纪,租地农场发生了变化,那些持有大面积土地的人成为了新时代的租地农场主。第三部分是结论,对英国12-16世纪的租赁持有者进行总体的论述。
[Abstract]:This is an article on the 12-16 century British farmers' land rights.
