仓桥律师事务所发展战略研究

【摘要】:近年来,随着我国社会经济的发展,人们的法制观念逐步增强,法律服务需求逐年旺盛,自1979年律师制度恢复以来,大大小小的律师事务所应运而生,律师行业蓬勃发展。截止目前,全国共有律师事务所2.4万家,律师总计29.7万人。律师作为一个特殊的法律群体,活跃在社会生活的各个层面,运用其专业知识助推法治进程的发展,其对社会经济秩序所起到的积极维护作用也得到了越来越广泛的认可。尤其是“振兴东北老工业基地”、“一带一路”口号的提出,更是给律师行业带来了前所未有的发展机遇。但与此同时,国内法律服务市场普遍面临的管理缺失、组织机构不健全等问题也日益浮出水面。例如,律师事务所过度重视其自身的发展规模及成长速度,在缺乏战略引导的情况下大肆扩张,最终因盲目走向衰亡。近年来,随着国际经贸合作的日益增多,部分外国律师事务所逐步进入中国市场,不断在中国一线、二线城市设立分支机构,并以其成熟的管理模式、高端的服务质量吸引了越来越多国内客户的广泛关注,这对于中国本土律师事务所来讲无疑是一个重大的危机和挑战。本论文所探讨的仓桥律师事务所成立于2008年,在长春市设立,是一家中小规模的合伙制律师事务所。律师事务所成立近十年来,取得了良好的社会效益和经济效益,近年来,区域经济的快速发展给仓桥律师事务所提供了良好的外部发展机遇,大大增加了律师活动的空间范围。但律师事务所以及律师数量的逐年增多也加剧了行业竞争态势,同时,仓桥律师事务所自身存在的战略缺失、组织结构不健全、管理体制涣散等问题也给律师事务所的进一步发展设置了很大的障碍,使得律师事务所在近几年的发展过程中感受到了强烈的竞争压力,甚至一度陷入发展瓶颈。笔者从事律师工作近五年,通过对律师执业生活及所处环境的认知和了解,运用MBA期间学到的管理学相关知识,利用PEST分析法、SWOT分析法、波特五力模型等综合分析了仓桥律师事务所目前所处的内、外部环境,评估了其自身的优势、劣势及所面临的机会和威胁,并根据律师事务所自身条件及市场需求,为仓桥律师事务所制定了一套专业化与差异化相结合的发展战略,并为战略的实施做出了具体详尽的规划及相关保障措施,希望为处于瓶颈期的仓桥律师事务所提供一些切实可行的建议和帮助,另外,由于仓桥律师事务所是目前国内中小规模律师事务所的一个缩影,其经营状态及所面临的问题也反映了行业现状,因此,希望该战略方案也能够对处于相似困境的其他律师事务所提供一些有价值的参考和借鉴。
[Abstract]:In recent years, with the development of our social economy, people's legal awareness gradually increased, the demand for legal services has strong, since 1979 since the resumption of the lawyer system came into being, large and small firms, lawyers industry vigorous development. Up to now, a total of 2.4 law firm lawyers million, a total of 297 thousand people. As a lawyer special legal group, active in all aspects of social life, to use their professional knowledge to boost the development of the rule of law, and actively safeguard the role played by the social and economic order has been more and more widely recognized. Especially the "revitalizing the northeast old industrial base", "the Belt and Road Initiative" slogan, more bring development opportunities to the hitherto unknown legal profession. But at the same time, the domestic legal service market generally faced with the lack of management, imperfect organization and other issues are also increasingly floating Out of the water. For example, firm pays too much attention to its own scale of development and growth, vigorously expand in the case of lack of strategic guidance, eventually because of the blind to decline. In recent years, along with the increasing of international trade and economic cooperation, some foreign law firms gradually entered the market in Chinese, China line, second tier city branch institutions, and its mature management mode, high service quality has attracted wide attention of more and more domestic customers, this is undoubtedly a major crisis and challenge for China local law firms. Firms kurahashi this study was founded in 2008, set up in Changchun City, is a small and medium scale the partnership law firms. The firm was established nearly ten years, and achieved good social and economic benefits, in recent years, the rapid development of the regional economy to kurahashi Provides a good external opportunities for development firm, has greatly increased the scope of activities of the lawyers law firms and lawyers. But the number is increasing year by year intensified industry competition situation, at the same time, the lack of strategy of kurahashi lawyers of their own existence, the organizational structure is not perfect, the management system and problems for further development of the law firm set a lot of obstacles, the law firms feel a strong competitive pressure in recent years of the development process, and even once caught in the bottleneck. The author engaged in the legal work for nearly five years, according to lawyers life and environment awareness and understanding, knowledge learned by MBA during the period of management, analysis by using the method of PEST, SWOT analysis, Potter five forces model analyzed kurahashi firm at present in the external environment, the evaluation of its own The advantages, disadvantages and opportunities and threats facing, and according to the law firm's own condition and market demand, the development strategy for kurahashi LLP has developed a set of specialization and differentiation are combined, and for the implementation of strategies to make a detailed planning and related security measures, hoping to provide some practical suggestions and help for the firm kurahashi in the bottleneck in the kurahashi law firm is a microcosm of domestic small and medium-sized firms at present, its operating status and problems, also reflects the industry present situation, therefore, other law firms hope this strategy can also provide some in a similar predicament valuable reference.
