论中国的文治传统

【摘要】:在政治统治的意义上,每个民族存在着自己独特的政治文化传统,其关系着民族在历史上生存的独特样貌,本文试图说明中国的政治传统是一种文治传统:所谓"文"乃"道之显者","文治"乃指帝王以"政治宣言"的形式,宣称自己统治的合法性和神圣性,同时可以聚合人心,并进行自我约束;然而这种自我宣称式的自我制约,归根结底是比较无力的。这种文治传统区别于西方的法治传统,又由于笔者是在"每一民族每一历史时期都有规定自身存在的根本"的意义上进行论述的,所以这种政治传统的论述同时也是一种民族根本法问题。这种民族根本法不同于西方的自然法或正义原则,其实质具有社会法色彩的根本规矩,既有客观的强制性,又能用来聚合人心。
[Abstract]:In the sense of political rule, each nation has its own unique political and cultural tradition, which is related to the unique appearance of the nation in history. This paper attempts to explain that the Chinese political tradition is a tradition of rule of civilization: the so-called "literature" is the "manifest of Tao", and the "rule of civilization" refers to the monarch declaring the legitimacy and sanctity of his rule in the form of a "political declaration", and at the same time he can rally the hearts of the people. And self-restraint; however, this self-proclaimed self-restraint, in the final analysis is more powerless. This tradition is different from the tradition of rule by law in the West, and because the author discusses it in the sense of "every nation has its own foundation of existence in every historical period". Therefore this kind of political tradition exposition is also a kind of national root law question at the same time. This national fundamental law is different from the western natural law or the principle of justice, its essence has the basic rule of social law color, not only objective compulsion, but also can be used to gather people.
