制度正义视域下权利冲突现象及其解决

【摘要】：权利问题一直是学术界研究的重大问题,但过去的研究大多局限于法学领域,其他领域研究很少涉及权利问题。这与我们通常只是在法律意义上来理解权利,认为只有在法律上才有权利可言有关。其实,自十一届三中全会以来,随着改革开放政策全面、广泛而深入地实行,权利问题在社会生活和交往中的地位日渐凸显,权利类型逐步增多,各项权利的内涵迅速拓展。权利张扬的同时,权利冲突等问题也不断地凸现,并已成为我们这样一个变革时代的热点问题。对权利个体而言,产生冲突时其合法权益总会受到某种程度的伤害,显然,这样没有达到对公民权利的保护。对社会整体来讲,权利冲突也会造成对某些现有的社会制度的侵害,社会公正性将会缺失,公民自由发展受限,社会健康和谐向前发展的势头必然受阻。在制度正义视域下研究当代中国权利冲突现象,是本文关注的重点,这其中又包括对权利冲突产生根源和解决原则的考察,并进一步在人类实践中正确把握权利冲突问题,从而促进公民社会良好秩序和公平正义发展环境的形成,为人的自由全面发展创造条件。有鉴于此,第一,本文从权利概念出发,探究了权利的历史演进、本质体现和基本价值,进而引出对权利冲突的类型、本质的分析,奠定了全篇文章的研究基础；第二,考察了当代中国公民权利冲突现状,为解决权利冲突现象提供了研究资料；第三,强调了制度正义对于公民权利冲突现象的重要性,论证制度正义如何保障公民权利不受侵犯和伤害；第四,探索了当代中国公民权利冲突的解决路径,对保护公民权利避免冲突进行了思考。
[Abstract]:The issue of rights has always been a major issue in academic circles, but most of the previous studies were confined to the field of law, and few studies in other fields concerned with the issue of rights. This is related to the fact that we usually understand rights only in the sense of law. In fact, since the third Plenary session of the Eleventh Central Committee, with the comprehensive reform and opening up policy, extensive and in-depth implementation, the status of rights in social life and exchanges is increasingly prominent, the types of rights gradually increased, and the connotation of rights rapidly expanded. At the same time, the rights conflict and other issues have been highlighted, and have become a hot issue in our time of change. For individual rights, the legitimate rights and interests are always harmed to some extent when conflicts arise, which obviously does not protect civil rights. To the society as a whole, the conflict of rights will also result in the infringement of some existing social systems, the lack of social justice, the restriction of the development of civil liberties, and the inevitable hindrance of the healthy and harmonious development of the society. It is the focus of this paper to study the conflict of rights in contemporary China from the perspective of institutional justice, which includes the investigation of the origin of the conflict of rights and the principle of solving it, and the further understanding of the conflict of rights in human practice. In order to promote the formation of civil society good order and fair and just development environment, create conditions for the free and comprehensive development of human. In view of this, firstly, this paper probes into the historical evolution, essential embodiment and basic value of the right from the perspective of the concept of right, and then leads to the analysis of the type and essence of the conflict of rights, which lays the foundation for the research of the whole article. This paper examines the current situation of civil rights conflict in contemporary China, and provides research materials for resolving the conflict of rights. Thirdly, it emphasizes the importance of institutional justice to the phenomenon of civil rights conflict. Fourth, it explores the ways to solve the conflict of civil rights in contemporary China, and thinks about how to protect civil rights from conflict.
