【摘要】:支付宝,这个广泛出现在智能手机中的应用软件,已经成为当代人们经济生活中的重要工具。随着支付宝、微信支付等平台的快速发展,第三方支付给我们的生活带来了极大的方便,成为我们生活中的得力助手。然而随着第三方支付越来越普及,与客户的粘性越来越大,出现的问题也随即增多。尤其近年来,关于消费者权益受到侵害的新闻报道层出不穷,使得我国对于第三方支付法律监管这一领域逐渐重视起来。中国人民银行自2010年就先后颁布了一系列规范性法律文件来规范第三方支付行业。比如2010年的《非金融支付机构服务管理办法办法》将第三方支付机构纳入了央行的监管范围;2015年的《非银行支付机构网络支付业务管理办法》更进一步地对第三方支付监管的法律体系进行了完善,对第三方支付机构的账户管理、风险管理等方面进行了进一步的明确。但是与美国欧盟等第三方支付发展较早的国家地区相比,我国的监管制度还有一定的缺陷,相关的法律法规仍有待完善。当前对于规范第三方支付的法律,在立法层级和体系、沉淀资金的监管、消费者救济渠道、不正当竞争和垄断行为规定以及技术规范等方面存在一系列问题,我国应当结合欧美对第三方支付监管的先进经验,进一步改善监管现状。要完善第三方支付的法律监管体系,就要构建以央行为中心的全方位监管体制。我国目前监管的法律主体为中国人民银行(即央行),这种单一的监管体制对当前正在蓬勃发展的第三方支付市场无法提供有效的保障,所以应当鼓励行业组织和社会公众有序参与到第三方支付的监管中,毕竟第三方支付和它的用户关系密切。其次,关于沉淀资金的监管,借鉴欧美的经验并结合我国国情,建立资金保险制度,在规范第三方支付企业自身合理使用资金的同时维护消费者的合法权益。然而,随着第三方支付的膨胀,其涉及的业务也越来越多,一旦发生用户相关权益受到侵害的纠纷时,由于法律的滞后性,解决机制不健全,从而无法提供切实可行的、有效的解决办法,因此要完善消费者的救济渠道,健全投诉制度。再次,通过立法来加强对不正当竞争和垄断行为的监管。通过设立防止第三方支付垄断的法律,以及明确关于第三方支付机构反垄断的监管主体,同时协调第三方支付企业和商业银行的关系。最后,鼓励技术创新,以科技进步来完善监管。第三方支付在短短的时间内发展迅速,得益于科技的发展,同样,技术的不断完善也能保障第三方支付在安全的环境下成长。总之,法律对于"支付宝"这类新兴产业应当持一种保护的态度,法律是充当"保镖"的角色,监管的目的不是为了抑制它,而是为了保障其更好地发展。
[Abstract]:Alipay, the application software is widely used in the intelligent mobile phone, has become an important tool in contemporary economic life of the people. With the rapid development of Alipay, WeChat and other payment platform, the third party payment to our lives has brought great convenience, become our life assistant. However, as the third party payments become more and more popular, the stickiness of the customers is increasing, and the problems are increasing. Especially in recent years, news reports about the infringement of consumers' rights and interests are endless, which makes our country pay more attention to the field of legal supervision of the third party payment. The people's Bank of China has issued a series of normative legal documents in 2010 to standardize the third party payment industry. For example, in 2010 the "non-financial payment service management approach" will be the third party payment institutions institutions into the central bank's regulatory scope; in 2015 the "non bank payment institutions online payment service management approach" and further to the third party payment supervision legal system is perfect, the third party payment account management, agency risk management of the further clear. However, compared with the other three countries, such as the US and the European Union, China's regulatory system still has some shortcomings, and the relevant laws and regulations still need to be improved. The current standard for the third party payment law, in the legislative level and system, precipitation funds regulation, consumer relief channels, unfair competition and monopoly regulations and technical specifications and other aspects of a series of problems, our country should be combined with the advanced experience of Europe and the United States on the third party payment regulation, to further improve the supervision of the status quo. In order to improve the legal supervision system of the third party payment, we should build an omni-directional supervision system with the center of the central action. China's legal supervision for the people's Bank of China (bank), the current single regulatory system to the vigorous development of the third party payment market cannot provide effective protection, so should encourage industry organizations and the public in order to participate in the third party payment regulation, after all, the third party payment and its user relationship close. Secondly, on the supervision of precipitation funds, we should learn from the experience of Europe and America and combine our national conditions to establish the insurance system of capital, in order to maintain the legitimate rights and interests of consumers while standardizing the third party payment enterprises' rational use of funds. However, with the expansion of the third party payment, the business is more and more, once the user has violated the relevant rights disputes, due to the lag of law, solving mechanism is not perfect, which can not provide a feasible and effective solution, thus to improve the consumer relief channels, improve the complaints system. Thirdly, we should strengthen the supervision of unfair competition and monopoly through legislation. By establishing the law to prevent the monopoly of the third party payment, and clarify the regulatory body of the third party payment agency's anti-monopoly, at the same time, coordinate the relationship between the third party payment enterprises and commercial banks. Finally, we should encourage technological innovation and improve the supervision with the progress of science and technology. The third party payment has developed rapidly in a short time. Thanks to the development of technology, the continuous improvement of technology can also ensure the growth of the third party payment in a safe environment. In a word, the law for "Alipay" this kind of emerging industries should hold a protective attitude, the law is to act as "bodyguard" role, the regulatory purpose is not to suppress it, but in order to ensure the better development.
