【摘要】：信息化科技迅速发展,使得个人信息的交流更加迅速,科技在带给人们便利的同时,也导致个人信息被非法的收集、利用、泄露甚至篡改。个人信息除了被公权力利用外,也包含了具有经济价值的社会资源。当前社会通过制定法律给予个人信息保护已成为大陆法系国家的首要选择,但是我国由于历史原因和现实原因,并未形成一个专有法律对其进行有效的保护。本文首先对个人信息的概念进行界定,对其范围进行一个初步的了解。在此基础上分析域外国家在个人信息保护上采取的立法理念、价值取向以及立法模式的选择,之后分析我国个人信息法律保护现状、存在的问题以及产生的原因,最后,针对我国个人信息法律保护的现实并在借鉴域外国家个人信息立法保护经验的基础上,提出了我国在构建个人信息法律保护时应当秉持的价值取向、立法理念、基本原则以及模式选择。本文共分为五个部分,第一部分是引言,主要阐述研究的背景、研究的方法和研究的现状。第二部分是阐述个人信息的基本理论问题,在具体界定“个人信息”的概念及范围的基础上,着重分析个人信息与个人隐私的区别和联系。第三部分是介绍当前个人信息立法保护的两种模式,吸取其优点,剔除其糟粕,为我国保护个人信息提供借鉴。第四部分是指出我国个人信息法律保护的现状、存在问题以及产生的原因。第五部分是具体分析如何完善我国个人信息法律保护制度,主要从个人自我保护、立法、司法三个方面进行详细阐述,以期能够更好维护个人信息安全和信息自由流通,促进社会和谐发展。

The fifth part is a detailed analysis of how to improve the legal protection of our personal information system, mainly from the personal protection legislation, elaborates three aspects of justice, in order to better safeguard the security of personal information and the free flow of information, promote the harmonious development of society.
