我国公民参与公共行政决策问题研究

【摘要】：中共十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》明确指出,要“更加注重健全民主制度、丰富民主形式,从各层次各领域扩大公民有序政治参与”,“推进协商民主广泛多层制度化发展”。要实现公民有序政治参与这一要求,必然要求公民有能够参与到政治活动的渠道,而公民参与行政决策正是公民参与社会主义民主政治活动的渠道。因此,开展系统深入的公民参与行政决策研究具有重要的理论意义与实践意义。公民参与行政决策是实现宪法赋予公民监督政府权力的重要手段,也是促进由传统型政府向治理型政府转变的重要途径,同时也是实现人民当家作主的实质所在。近年来,随着行政公开化的推动,我国在公民参与行政决策方面进行了有益的探索,比如:信访制度、听证会制度、重大决策的公示制度等方面,都取得了一定的进步。但是,目前我国公民参与行政决策仍然存在许多问题:公民参与决策的制度化不足、参与决策的渠道不畅通、参与决策的能力不足、缺乏代表性、政府对公民参与决策观念的误解、公民获取政府信息难度大等问题,这表明公民参与行政决策需要在制度化、法治化、规范化等方面进行完善。因此,要解决我国公民参与行政决策存在的问题,一方面,我们应该借鉴西方发达国家公民参与行政决策的先进理论以及实践经验,并在引进国外先进理论的基础上,构建具有中国特色的公民参与行政决策理论及方法。另一方面,应该尽快构建我国公民参与行政决策的机制,完善我国公民参与的正式化渠道和非正式化渠道以及完善公共行政决策体制,这是当前我国实现国家治理能力和治理体系现代化的重要一环。

We should expand citizens' orderly political participation in all fields at all levels "and" promote the extensive and multi-level institutionalized development of deliberative democracy. "it is necessary to realize the requirement of orderly political participation of citizens." It is necessary for citizens to have channels to participate in political activities, and citizen participation in administrative decision-making is the channel for citizens to participate in socialist democratic political activities. It is of great theoretical and practical significance to carry out systematic and in-depth research on citizen participation in administrative decision-making. Citizen participation in administrative decision-making is an important means to realize the constitutional power to supervise the government. It is also an important way to promote the transformation from traditional government to governance-oriented government, but also to realize the essence of people as masters. In recent years, with the promotion of administrative openness. Our country has carried on the beneficial exploration in the citizen participation in the administrative decision, for example: the letter and visit system, the hearing system, the important decision-making publicity system and so on, has made certain progress. However. At present, there are still many problems in the participation of citizens in administrative decision-making: the systematization of citizen participation in decision-making is insufficient, the channels of participation in decision-making are not smooth, the ability to participate in decision-making is insufficient, and there is a lack of representativeness. The misunderstanding of the concept of citizen participation in decision-making and the difficulty for citizens to obtain government information indicate that citizens' participation in administrative decision-making needs to be improved in the aspects of institutionalization, rule of law, standardization and so on. In order to solve the problems of citizen participation in administrative decision-making in our country, on the one hand, we should draw lessons from the advanced theory and practical experience of citizen participation in administrative decision-making in western developed countries, and on the basis of introducing foreign advanced theories. On the other hand, we should construct the mechanism of citizen participation in administrative decision-making as soon as possible. To perfect the formal and informal channels of citizen participation and to perfect the decision-making system of public administration is an important part of our country to realize the modernization of national governance ability and governance system.
