秘密窃取网络虚拟财产行为的司法认定

【摘要】：随着计算机技术的发展和互联网的普及,网络虚拟财产开始成为人们追求物质生活闲暇之余的精神寄托。伴随着空间和区域概念的淡化,虚拟空间应运而生,而网络虚拟财产在网络空间也发挥着越来越重要的作用。虚拟财产是在网络空间中人们花费时间、精力、金钱、智力而获得的劳动成果,它的价值不亚于现实中真实的财产。正是由于虚拟财产的利益性,秘密窃取网络虚拟财产的案件频繁发生,如网络游戏虚拟财产的失窃、网络账号被盗取等事件。由于我国法律对网络虚拟财产的法律属性没有明确规定,所以在初始,对于此类案件,不以犯罪定罪处罚。对于虚拟财产的法律属性,有肯定说和否定说。但是对于肯定虚拟财产法律属性的,对于其以何种形态存在,又有物权说、债权说、无形财产说、知识产权说,本文认为虚拟财产本质属性应当属于物权说。现在对于秘密窃取网络虚拟财产的行为,多以刑法进行规制,由于我国立法上对此行为没有明确的规定,此类案件无法可依,导致在司法实践上司法机关对于此类案件的定罪量刑出现不一致的情形。有的司法机关以侵犯通信自由罪处罚,有的司法机关以破坏计算机信息系统罪定罪量刑,有的以非法获取计算机信息数据罪或者盗窃罪定罪处罚。本文认为秘密窃取网络虚拟财产行为应构成盗窃罪,因为构成盗窃罪具有合理的法律依据,并且符合罪刑法定原则的,最主要的是秘密窃取网络虚拟财产行为完全符合盗窃罪的构成要件。本文通过论述司法实践中构成其他犯罪的局限性来更好地说明构成盗窃罪的合理性。但是由于网络虚拟财产是存在于网络空间内的电磁记录,本身具有虚拟性等特征,在认定盗窃罪的过程中会出现一些问题。虚拟财产所有者身份混乱,所有权归属问题出现争议,虚拟财产的价值评估标准五花八门,造成了虚拟财产的价格难以准确评估,由于虚拟财产的证据容易灭失,所以获取电子证据困难,由于虚拟财产属于高科技犯罪,盗窃罪既遂与未遂的认定标准困难,这些问题对于盗窃罪的认定至关重要,本文针对认定过程中出现的问题提出相应的解决方案,以便能够更好地定罪量刑。对盗窃网络虚拟财产行为进行法律定性,具有巨大的社会意义和司法意义:首先,可以有效防止同一案情不同定罪的情况出现,能够更好的实现罪刑法定;其次,能够保护网络虚拟财产所有人的合法利益,促进我国网络游戏产业的健康发展;最后,可以使网络虚拟财产得到及时、有效、全面的法律保护,可以净化网络空间、促进社会稳定。

The legal nature of the behavior of stealing virtual property, which has great social significance and judicial significance: first, can effectively prevent the same conviction of different situation, to achieve better legality; secondly, to protect the network virtual property owner's legitimate interests, and promote the healthy development of online game industry in China; finally, the network virtual property can make timely, effective, comprehensive legal protection, can purify network space, and promote social stability.
